i-130 denial
Please, I need your opinion on what to do if I forget to notify uscis of my Vawa application and my previous i-130 was denied due to abandonment. So what can I do in order to avoid being placed in removal proceeding as my Vawa is still pending.

Even if you notify USCIS about your Vawa petition, they would still deny your I-130 that’s the normal procedure because you can’t withdraw it as you are just the beneficiary and not the applicant. Sometimes they deny after they call you in for an interview or somewhere down the line if they don’t call you in for an interview but they would definitely have to deny it. Did you file a separate I-485 with your Vawa or your are converting the old one you filed with the I-130? I would advice you file another I-485 for your Vawa as some field office would deny your I-485 you filed concurrently with the I-130 based on the fact that the I-485 cannot stand alone as it rest on the I-130 and since it precedes your Vawa filing you can’t convert it to your Vawa. I had the same issue and was adviced to file another I-485 when I went in for my I-130 interview after filing for Vawa.

I filled a new i-485 already with my Vawa Application.

@Aji oy Then you are good. Did you withdraw your previous I-485 or it was denied or it’s still been held in abeyance?

like my own when i fill my vawa I told USCIS to link my previous I-485 to my vawa and they responded by re-issued receipt notice and asked for the evidence of filling of vawa. So does that mean it was linked to my vawa?

@Aji oy If you they deny your i-130 they will deny your i-485 which is attached to it and it will render your work authorization and travel document issued void but if you withdraw the i-485 since you have filed another one for your vawa it won't affect it. However I would advice you file another work authorization and travel document under your i-485 filed with vawa but pls do consult with your lawyer. I had to withdraw my own filed concurrently with my i-130 and filed another i-485 first before I did that. my case is different from yours which is why I am asking you consult with your lawyer.

you are totally fine. they can’t do anything because your vawa is pending and you are in legal status. I had the same situation. no worries. my 485 and 130 was denied after I filed vawa. I’m totally fine and USCIS supervisor told me that I’m fine and just wait for my vawa approval .
