I-130 approved, removal proceedings dismissal
hello friends,
• My removal proceedings have been administratively closed for over a year now.
• Two months ago, I got my I-130 approved but uscis closed my I-485 petition admistratively bc my case is still in court and not properly dismissed yet. I would like to know the next step of action.
I’ve been told multiple things by different attorneys, but I need someone’s experience to move forward. is the next step requesting dismissal of the removal proceedings from court or is it asking to recalendar hearing and then dismissing the case at the hearing? pls share your opinions and experiences, thank you!!!

congratulations on your approval im on the same boat
from what my attorney explained to me was you ask to get it recalendar and ask to have proceedings terminated if you qualify you may ask judge to grant you your green card if not then once case is terminated you would have to send the proof to uscis and have them reopen your I-485

@Chris E first you have to get your case dismissed are terminated from court once that happens you go back to uscis with the letter from the court and ask to reopen are you can refile again with everything like my lawyer did because my first i485 was just stuck best of luck

Ask your lawyer to send a letter to the court with the approved I-130 petition, requesting dismissal or termination of your case. Don’t wait until your hearing, as you could lose valuable time. Try as many times as you need, it took me 3 attempts with Cleveland immigration court.
Only after the case is dismissed can you apply for your green card with USCIS and you will need to attach judge’s dismissal. good luck!

since your removal proceedings are administratively closed, you do need to "recalendar" your case. End goal is to terminate the case but you don't need to wait for an actual hearing.
your lawyer can do it all in one motion "motion to recalendar and terminate removal proceedings without prejudice".

@Sharan hada I filed termination of removal in July and now awaiting the judge to respond. until that is done, my I-485 case remains administratively closed by USCIS.
