i-130 Approved.. But!
Hey guys, my case for my wife who is currently overseas got approved yesterday, but in the approval letter it says that USCIS retained my file until I either file form i-485 or form i-824.
They said "The above petition has been approved. However, you indicated on the petition that the beneficiary intends to apply for an immigrant visa abroad at a U.S.
Embassy or a U.S. Consulate and will also apply for adjustment of status in the United States. Since you have indicated both options, USCIS has retained
the petition..
what should I do now? please advise. 🙏
i really don't want to file a new form and pay almost $500 for fees and then wait longer. I tried to call but the system hangs up on me everytime I ask for an agent. how do i connect to a live agent over the phone? anyone?
I'm frustrated

You probably want to contact them and clarify that your wife is overseas and will apply via a Consulate, and not adjustment of status in the US.

I suspect they’re going to make you file the I-824 but it’s worth a shot. Try using Emma to connect to a live agent

To speak to a live agent. Call the number and when the machine ask ….. what can I do for you today?, say “ info pass”. Then hold on, it will transfer you to a live agent.

thank you so much guys. I did speak to an agent and they put a request for me to get my case transferred to NVC. so let's wait and hope for the best.

my petitioner called uscis I received the same letter 24 days ago that they approved me and they told him that they would send my case to the NvC that did not send the form I am waiting too

@Layth - so basically when you called the agent he made a request on behalf of you and sent the request to transfer your case to NVC? OR you filed form I 824 to make this happen? please help

G T, yes i called and the agent made a request on my behalf to send the case to the NVC. no response yet 🤷♂️

you filed this right. but there's a question before that saying that beneficiary will apply in the US. it you left this blank, then you should be fine

Hello Layth, I did the same and filled both 61 and 62 options. they approved by my father's case in September 2022. but retained his case and wants me to file another form I-824. since than I am struggling. please tell me did they made you file I-824 Or they sent it to NVC.

I have the same problem. I have applied for a tourist visa, filled out form I 824, and sent 2x465 usd too . This is just ridiculous. Just because I typed a word to 61a , we are all suffering :(
