i-130 approved after 19 months - Potomac
Married with USC while in removal proceeding
I-130 never been approved since Nov 2020. Asked helped from congressperson, file e-request, chat Emma, nothing helped.
Had to push it by filing I-485 Feb 2022, fully aware that USCIS can’t approved I-485 until my removal proceeding terminated by immigration judge ( need that I-130 approval letter for that )
6/28/22 interview date, IO said from the beginning That She can only interviewed us for I-130 and not I-485 will be administrative closure. ( totally understand ).
She Asked if there’s extra evidences, I gave her 500 pages extra evidences and told her to pick and choose from it herself + 2 photo albums. Husband told her that I prepared the evidences myself and IO said “great package, nicely done “
She never separated us, interview last 30 mnts. Just standard questions about relationship and stuffs. No interrogation and more like talking to a nice stranger. Super chill
Told us 3 times she will approve I-130 and wish she can approve the GC application if it’s not because of removal proceeding. She took all of 500 pages extra evidences ( I’m super surprised )
6/30/22 case being “touched” again “case actively being reviewed “, check the document tab and saw approval letter
7/1/22 case changed to “ case approved”
PS. i have a lawyer
my lawyer already filed PD last month to OPLA but no news yet. i called immigration court for hearing date and they give me December 2023 🤣

I’m in the same boat with you brother . my i130 got approved in January but my court date is sep 2023 . I have file motion to advance with immigration court

Same boat same timeline and approval , except i have not filed 485 yet, interview was 15 minutes and approval onspot. now will file 485 and send my invoice to the court .

in similar situation, I am trying to move my court case forward by sending all my documents to the court. But my lawyer said the Maryland court has been dismissing cases of u hv approved i130 but she said we should still try because it’s the faster route instead of going through USCIS

lammy : my lawyer told me Boston immigration court is super backed up. i just called the court yesterday and they gave me hearing date for December 2023 haha

@domino 22 do you think you could file I-485 without waiting 2 years or is it only allowed if your I-130 outside of normal processing time?

i can. i filed I-485 just because my lawyer told me PD is back so he said nothing to lose just try I-485 and hopefully OPLA approved PD ( joint motion). but my lawyer is super late applying for PD and I got interview 3 months after I-485 was filed, hence…I don’t have termination letter on hand

@llya you can file the i485 while i 130 is pending. I did the same thing and my interview was scheduled but only on the i130 because I was in removal proceedings. the immigration officer told me he will only approve the i 130 and put 485 on hold .

@Francis will you have another interview with USCIS when your court case is closed? or now I-485 needs to be approved through the court only?

due to backlog at the court . judges are terminating cases which still has uscis approval. But I prefer to do the adjustment with the court because is more easier and faster so I fill motion to advance at the court . But if the judge terminate it and send it back to uscis. It will depend on the immigration officer reviewing your case . He said i can be called for another interview or not . But I shouldn’t just leave the country that’s his advice to me

I went though all of that. I am just a step ahead of you. Judge has terminated my removal. I wrote to uscis to adjudicate my I485 over a moth ago, no response yet. I don't know.
I think it is good to get out or removal proceedings, but I am not sure how long it will take uscis to adjudicate you I-485.

doesn’t matter because photo albums just to show to the IO and not for them to keep. i only have 14 pictures total in plain paper for them

I485 was granted by immigration judge on dec 16th - waiting on tier2 agent to call for infopass appointment to submit approval and get green card.

@domino 23: can you please specify where you sent your i-485 form, is it to the immigration court your case at or to uscis addresses depending on respondent location ? i am in removal proceeding since 2020 with no future hearings "just pending status" and i have just filed i-130 3 months ago and i don't wanna be stuck waiting approval, i want to proceed like you did
