I would like to seek your guidance regarding the process of bringing my wife to the United States. Here is a summary of my current situation: • I first married in 2020 and received my green card in May 2021 through that marriage. • I became a naturalized U.S. citizen in September 2024. • That marriage ended in divorce in February 2025. • I recently remarried in June 2025. My new wife is currently residing in India, and I live in New Jersey. • She is currently pregnant with my child. • Prior to our marriage, she applied for an F-1 student visa but was denied under Section 214(b). Given these circumstances, I would like to know the best and most efficient immigration pathway to bring my wife to the U.S. if her previous F-1 denial might impact the spousal visa process.

@Malik Z File I-130 immediately. Then you can file I-129f (k3) to have her in the US faster. Expedite the process because she is pregnant.

@Malik Z Your fact pattern is quite concerning. With your timeline, they are gonna say the pregnant lady in India has always been your real wife and you came here to get a greencard through the former wife and then turn around to sponsor your real wife. You are moving too quickly. Your immigration history is more of a problem for both of you that her denied F-1 so you are clearly worried about the wrong thing.

@Malik Z Is she able to visit you? Not telling you to do this but she can come visit and you do a AOS then she is here but then they might try to say you are being fraudulent. I agree with @Rocco Forté that your history will not be good with this process. Expect to be really scrutinized. You can do the 130 and also file to try and have her come to the US quickly but I am not sure they will consider this. You are in a difficult situation. I wish you the best.

your timeline makes it look like you were not in the first marriage for good reasons, I would definitely wait because I don’t know if they would start looking into your case again for previous marriage. you divorced and married in the same year and your new wife is pregnant? how soon after getting your green card did you split with your ex wife? (you don’t have to answer that) just giving examples of how it looks

@Malik Z You need to start gathering evidence about your first marriage to be able to prove it was real and also why it ended. Did your ex wife end the marriage, did you try counselling, those types of things.
