humanitarian reinstatement
my father filed 2020 humanitarian . i dont know how long it takes uscis will answer . can anyone help me to know

@jomari iresare some revocations sometimes deny the HR. that happened to me and I had to appeal and they already reopened my case and I am already in the approval process, waiting for the final decision.

They denied it because the lawyer makes some mistakes and lacks evidence. USCIS puts the reasons in the letter. what category are you?

@jomari iresare when they say that 50/50 they don't know how to work or they are afraid. Some lawyers told me the same thing. but the lawyer I have took it and now my case is reopened. And did you get the revocation letter? what does it say? and they answered you. You have to see what the revocation instructions say

@jomari iresare it may be that you were denied your HR in your revocation and need a lawyer. but I don't know what your revocation says. you have to act fast when an HR is denied because you only have 30 to 60 days to appeal

@jomari iresare I am trying to understand your case: In 2020 your dad filed request for Humanitarian Reinstatement; You received notification that it was received; your status show revocation- said to wait for approval; then you said no response yet- waiting for 3 years; then you said yes- revocation received. Questions: 1. Who is the beneficiary- you or your father? 2. What is the " paper form of humanitarian?" 3. Did the revocation letter state that you should file I-290 B Motion to Reopen? 4. If so, how much time were you given?

@jomari iresare USCIS says that an approved petition is automatically revoked upon death of the petitioner. However, USCIS can reinstate the petition based on humanitarian grounds. Request must be made by the beneficiary. From what I understand, when USCIS responds to the humanitarian request, they usually provide instructions on what to do next. @Argenis Garcia has gone through this so can advise you.

@jomari iresare so the revocation notification is normal because all petitions are automatically revoked once the petitioner passes away. what Argenis’s case is (if I understand correctly); they filed for reinstatement, and it is that request which was denied. so then they have filed a motion to reconsider. In your case, the revocation notice doesn’t mean denial of Humanitarian Reinstatement request. In your case have you tried following up via your congressional representative and/or the ombudsman office?

In my case, the revocation letter stated that my humanitarian reinstatement (HR) was denied by USCIS due to reasons and lack of evidence. However, my lawyer submitted an I-290B, a Motion to Reopen, within the 60-day window. After that, I received a letter from a different service center (Vermont) with a new receipt number (IOE) confirming that they received all the documents. Subsequently, I got two notifications on the USCIS phone, first stating that my case was reopened for reconsideration, and a day later, another notification confirming the reopening I-130 (case was reopened). Later, I received two Notices of Action (NOAs) within 10 days, informing me to wait for the final decision and that USCIS sent the case back to the State Department for action. Now, I’m patiently awaiting the final decision from USCIS.

@Sahil Patel Look at @jomari iresare comment # 7 where the response to @Argenis Garcia shows that "they said get an atty and appeal" This was after the HR was sent, but @jomari iresare comment # 2 also shows "they said wait for approval" Since it is not clear how much time was given for the " appeal" mentioned, neither the type of appeal suggested except to "get an attorney"..... @jomari iresare you can seek case assistance from your congressman, senator or the Ombudsman as suggested by @Sahil Patel. @jomari iresare you can find the congresspersons/senators details for case assistance on their websites. Ombudsman office they have a form to fill out on their website. Your case absolutely needs follow up from either of these offices. In my opinion from the ombudsman’s office will be more helpful. Our lawyers request to the ombudsman’s office was reviewed within 2 weeks and a week later USCIS has already reached out to my lawyer. they are currently communicating and figuring out what’s happening. Your case is way past due, do reach out or you might just be stuck waiting.
