How does the August Bulletin affect me?
Hi All, I filed my I-485, i765 and i131 all together in June 2023 when my PD dates were current. However, the recent visa bulletin dates are no longer current. EB1 dates went back to 2012. How does this affect me? Does that mean I will only get my i485 approved only when the dates again come back to current? Is there no benefit for me filing in June when the PD was current?

Ideally you should get your EAD and AP, even if your PD is not current now, because it was current when you applied.

@ti r not true - I485 starts the moment you file. in fact if you see USCIS manual - it says officers need to keep it ready until the point where the visa numbers are available to be allocated. one advantage that CK will get is EAD and AP until his visa is available.

the problem with Aug bulletin is that even filing is not available for PD after 2012. until this month, date of filing was being respected am from next month final action date would be considered.

@d s thanks for your response. when you said “until his visa is available”- what visa are you talking about? my H1B visa has expired long ago.

@d s :Yes. EAD and AP should available. Not true that officer will have visa numbers readily available to allocate once PD is current. Total active duration for I485 ranges 6 months to 18 months if PD is current. since CK's PD is Jun 23 it would take time after his PD is current.

sorry, I should have clarified. My actual PD is May 2019.

you won’t get GC unless your PD is current , you will only be eligible for EAD/AP

@C K Just calm down, you will get your GC after October 2023 when EB1 PD will be current again and will a visa becomes available.
