did you file C9 or C31 EAD?

yo y tenemos el mismo tiempo de prioridad parece q nuestros abogados sometieron por c31 yo volvi a enviar el formulario 765 con categoría c9 a ver ai me aprueban

tengo el permiso de viaje aprobado pero no lo eh usado 🙄 como viajo sino trabajo

@sam Dami C31. actually I needed to look them up what they were, and found out that c31 is “VAWA self-petitioners with an approved Form I-360” by USCIS. I’ve submitted EAD with I-360 together, so obviously my I-360 was not approved at any time.

@Rui Morito alguien me recomendó que hiciera el i765 bajo categoría c09 porque le paso lo mismo y a los 7 meses le llego el permiso, yo llevo 5 meses esperando que lo hice asi otra vez

if you had filed I-765 based on pending I-485 then you will receive a c9 ead

@Rui Morito No, the young woman who spoke to me, according to her experience, she only sent the i765 under c9 and her work permit arrived after 7 months. My lawyer did it again, they accepted the papers I sent and they waived my fee.

@Rui Morito you can still file the C9 category EAD

@Rui Morito please go and file a new I-765 under C@ category asap. cuz if it’s C31 then you will wait years until the approve your VAWA before you can get your EAD. so please don’t waste time and do the needful so that you can start working and make money to keep yourself afloat pending when your case will be approved okay 👍🏽. best of luck 🙏🏾

I’ve looking at the chart where to file from USCIS, but I don’t know which one is the best description for me waiting VAWA approval. Do you have any ideas? option is here; 1. Pending family-based Form I-485, application to register Permanent Resident or Adjust Status, 2. Pending employment-based Form I-485, 3. Pending Form I-485 based on: an approved form I-360 as a battered spouse/child/parent, T nonimmigrant status, U nonimmigrant status, or as an abused spouse or abused child of a qualifying Cuban Adjustment Act of Nov. 2, 1996, eligible spouse or parent.

@Rui Morito that would be option 2...file based on pending I-485...that's C09. If you can't understand the form please complete it with someone so you don't make a mistake.

@Rui Morito that's a copy of what my lawyer used to renew my EAD. This should be all you need. I tried to edit out some stuff so numbers may be off :)

@Rui Morito my bad. When you're completing the I-765, select the (c)(9) option. It states it explicitly on the form- EAD based on pending I-485

@Rui Morito Mail the Form I-765 to Vermont Center and include evidence of the hardship you are going through since you left your husband. Better still, you can approach to live in Shelter and also get some benefits from state using your PF

@Rui Morito you're welcome but you don't need to send evidence of hardship. You are eligible to apply for I-765 if you have a pending I-485. Besides the form and what I mentioned, that's it!
