Need help please when I was married to an American citizen, I had sent l485 and l130 for my two children and I he had asked us for RFE for the children, we never responded because in the meantime the situation deteriorated, and I filed for divorce due to violence
Then March 6. I sent in my Vawa application for my two children and I accompanied by L, 360, each l765, renewal for me because mine expires in a month and l765 first request for my children. Today they closed my children's l485 because we had not responded to the rfe.
My request is please: when the lawyer sent my Vawa file, he didn't send a l485 because we had already sent it under Marriage. What do you think about this?

You need to submit another I-485 is better and peace of mind.

it will be reopened once your i360 approved, it will be a ground for the i485 to be adjudicated since the i130 don’t exist anymore.

your attorney is right. Your attorney will only need to write A letter to USCIS , NBC handling your I-130 to hold your I-485’in abeyance until your I-360’is approved.
