it really depends on which state you are in and which service center your case goes to. If your child and spouse both are in the states, you should file i130 and i485 concurrently

nope! there are in abroad. both petition were approved and waiting for interview abroad. I became a citizen and wants to upgrade and they asking me to apply separately for my daughter

I don’t believe they would upgrade your case. Because it’s not really necessary and I don’t think they do that. why do you need to upgrade it?

So I don’t think they can. because their cases are at the Embassy and not in NVC. You are done. Now they will get their Immigrant Visas and come to US. Then get their green cards

I think they misunderstood you. if your case is at the Embassy level, you are pretty much done.

the case not yet at embassy but with NVC all documents qualified for 10months waiting for an interview

huh. NVC is taking 3 months to send the case to Embassies. After that it’s embassy’s responsibility to schedule the interview

yeah 4 months a ago I learnt they are working in IR1 not F21 that’s why I wanted to upgrade to speed my case and it messed me up

don’t touch your case …. you couldn’t explain your question to them . and they didn’t give you right awnser…. just leave it as is … thanks

@nan 8 You did the right thing with updating your case to IR1 as the other category is moving extremely slow or not at all. What you need to do now is file another petition for your child as IR 2

@nicole Already did! the sad part was I paid all the visa fees to NVC for my child without refund and after approval I will pay another fees to NVC.

@nan 8 No you will not need to pay another fee when your child gets to NVC. I was in the same situation. All you need to do is to submit a Public enquiry to NVC and tell them that you had previously paid the fee and you would like them to transfer it to your child's new case number. You can download the receipt from your husband CEAC where you had previously paid it and attach it to the email as proof when your child gets to NVC. It's very simple. NVC won't refund the fee but they will transfer it to the child's new case

Okay, online, Texas Service Center. Depending on when your spouse was Documentarily qualified he may soon get an interview date

Okay thanks! I did mine online. When I was applying I submitted my child only passport photo without mine. I called them and they said if they need anything they will let me know. was worried

It depends on where your country is at. Mine took less than 2 months.

Yes, after I upgraded in September, I got interview date for November.
