hello. I need opinions about my situation thanks
I have VAWA approved. But also applied for the i485. I have an illegal entry on record, in 2011. I came into the USA twice, the first time i was cought and sent back and the second time i did not get caught. But i still decided to proceed with the application for i485 although we thought that it would be automatically denied because of the illegal entry. But USCIS saw my i485 case and asked me for the medical exams, which i already sent, and now USCIS is wanting to do an interview with me in March. My current lawyer says it doesn't make sense to go to that interview because im most likely to be denied i485 because of the illegal entry I have. But my question is, would uscis go through all that trouble just to deny it at the interview? And if they do deny the i485 could they possibly take away the approved VAWA that i have?

I don’t know why the lawyer would say not to go to your interview without knowing first hand what the officer will say, regardless of your illegal entry. Please go to your interview, you’ve already come this far. Go and see what’s left of your case. All the best to you.

@JOE BIDEN look for another experienced lawyer quickly, he can help in the uscis case decides to cancel your file, he can ask that we give you a guarantee of exit and return via the airport... you may be lucky that uscis approves your file directly because you were abused and your vawa is approved. you need a good lawyer even if you're going to pay him 2k to accompany you to the interview but your case can be approve whithout interview... how tell you ,you have interview in march? or did you received mail?

@JOE BIDEN @blessed & favored I fully agree with blessed and flavored. submit I601 before your interview date and make sure you take a copy of that with you to your appointment just to be on the safe side. Once you do that they can’t just deny your petition because of those illegal entries especially since your vawa is already approved. I would rather just file the I601 instead of getting risking your I485 getting denied and ending up with refiling it again.

@JOE BIDEN Your lawyer is RIGHT. You have a PERMANENT BAR. If he/she has found out that your LAST ENTRY is NOT directly related to your ABUSE then your chances of getting your I-485 approved is 0 even if you file I-601 waiver. The burden of proof is on you that directly links your entry or exit to the abuse by your US CITIZEN SPOUSE. Answer to your second question is No that cannot take your Approved VAWA case unless they find any FRAUD in the same. Good Luck!!

@JOE BIDEN you must listen to people like @Alan Menezes who based their opinion off YOUTUBE or by listening to themselves. If you don’t find people like @Alan Menezes opinions helpful then you should reach out to these God Loving People who are on this chat who would love to pray for you because it’s free and it doesn’t cost anything other than lip service. Just in case if you decide to look at the facts of your case, you must read the law. VAWA can forgive ONE illegal entry without any issues, but to be forgiven for the SECOND illegal reentry which leads to PERMANENT BAR. You must prove that your last entry or your exit is related to the abuse. You will be asked by the immigration officer to file a 601 waiver but a 601 waiver can only be approved if you can justify your second exit or reentry was related to the abuse. Again your lawyer is right listen to him or her if you chose to do so. If not then there are plenty of @Alan Menezes in this world to give you hope without facts and and some of them are ready to pray for you. Good Luck. 🍀

@JOE BIDEN it’s a hard one you need to apply for a waiver , also you do have a small chance of been approved but if you don’t have a criminal record and can explain your self really good there is hope if you decide to go make sure to go with your lawyer
