I know he supposed to because he wants divorce after I confront him of cheating. now he said he wants to marry another woman. he already have a court day for divorce.

if your husband already initiated the divorce, it doesn't matter who goes to the interview, your case is going to be denied, both I-130 and I-485.

I have a lawyer on my case from the beginning and he does nothing but fill the paperwork out that’s it. all he do is took my money.

@frenzy @gift You made a big mistake by confronting him about cheating on you. You should be tolerant of that and You should just ignore it till you get your green card and walk away from him. No matter what you are trying to do now your case is going to be denied both the I-130 and the I-485 because he already initiated the process of divorce. You should think about filing for VAWA now or you can beg him trying to convince him to cancel the process of divorce and get back together and tell him that you forgive him for cheating on you..,

I went for the interview he didn’t show up so they didn’t even interview me. and now they denied the I-130 😭

@frenzy @gift sorry to hear that! I really feel bad for you. You just wasted 3 years of your precious time with him. Now You need to focus on finding a good lawyer to help you with VAWA. You may need to collect some evidence from him about your relationship. You need to prove to the USCIS That you were in a genuine marriage and into in good faith and with the intention of building a future together with your husband but he cheated on you and this emotionally affected you.

keep the faith. thank you so very much for your encouragement not sure about getting anymore evidence from him as he just being a Bs and not answering the phone. but I have quite an amount. so I will work with that o just have to pickup the pieces and move on.

@frenzy @gift What is your current status in the US? Are you student? Do you still have a valid visa? Or are you currently out of status? If you don’t file for a VAWA and if you are currently over stayed in the us which means you are out of status then therefore USCIS will put you in removal proceedings

The lawyer will help you to file your VAWA application with the green card package I-485, I-765 for work permit and the travel document I-131.

keep faith but I learnt the man divorce me on Monday and I should expect documents through the mail. so will I still be able to file those. I have a consultation coming up with a lawyer. so much with this case

@frenzy @gift great! I think it’s enough as evidence. You definitely should consider filing for VAWA asap. But it’s going to be a long process 2 to 4 years to get your green card if everything goes well. But you should be aware that this is an election year things can change quickly depending on the election outcome. If Trump gets elected again it will be tough to adjust your status here
