Hi everyone I don’t know if anyone here has been through what I’m about to ask, please I need help. I came into the states 7years ago as an F1 student l, went to school for just 2 semesters and couldn’t continue before of my family problems, so I overstayed my visa. I got married in December 25th 2021 and filed in July 21st 2022. Got my work permit and still waiting for my 130 to be approved because I will be approved in Jesus name. Now this is the problem, I have an emergency and I applied for Emergency travel document, but everyone is saying once I go, there’s a probability I won’t be admitted again because I had overstayed my visa and that’s an offense. I thought marriage forgives overstaying 😩 please who has a similar case should help me.

as far as you’re still married to your spouse I don’t think you’d have issues.

whatever emergency can wait till you are guaranteed you will be allowed back into the USA… as it were , you are not guaranteed, so be patient. this time will pass!

I filled July 21st 2022, was scheduled for biometrics July 29th for August 17th. My 485 had been actively review since then. Got my Work permit January 17th, and my i130 went from 1 week in March to 4 months, then changed from 1 month to your case is taking longer than expected to process.
My father is in a critical condition is why I’m applying for an emergency travel document.

If you have your Emergency AP on hand, you should be fine.
