María mDec 25, 2021
what did you congressman say about it ?
call me BlessDec 25, 2021
uscis told my congressman they're doing require background check and because of this they can't tell me when it will be over .
CO GDec 25, 2021
same here, it’s ridiculous. reached out to my congressman just before the break and I was assigned a caseworker, praying I hear some good news after the break. I suggest you reach out to your congressman as well what is your pd?
Aa JJDec 25, 2021
background check always done before interview . how are they saying they are doing background check.
María mDec 25, 2021
@call me bless” what’s the point to go with congressman if usics is gonna say the same
S LDec 25, 2021
They are lying , they delay the case on purpose
amidou sawwadogoDec 25, 2021
my is year and three months
María mDec 25, 2021
still what can we do ?
amidou sawwadogoDec 25, 2021
Nothing bro I called them they said it not normal. they will back to me in months. still waiting
María mDec 26, 2021
what’s the process after the processing time of over ?
Waiting PatientlyDec 26, 2021
@. H Hh I absolutely thought the same thing… that background check is done before interview for obvious reasons. I mean what if the individual is dangerous? You cannot put them in room with an officer without making sure they are legit.
CO GDec 26, 2021
@amidou did you try reaching out to your congressman ?
Also my PD is October 2019 and I feel like there’s just a huge lag with cases that have a PD in 2019.
I hate it.
what is everyone’s PD ?
María mDec 26, 2021
mine is August 2020 . I don’t see that good can I do by contacting the congressman

When decisions taking too long after interview it's never a good new it happen to me after my interview I wait more than 11 months anytime I reach USCIS they told me background checks I did whatever I can do to make them take decision: Pression on my lawyer to send a letter asking for result, congressman and every 2 weeks I send an inquiry and under pression they scheduled another interview when I went there with my wife it's was another interviewer when she was checking my file of the first interview I saw clearly that the first interviewer wrote on my file : Denied and she asked what happened to the first interview? and I said I'm choked because everything was okay. So to be honest it taking long because the principal manager don't want to approve the denied and can ask for additional documents or wait couple months then approve or confirm the denied of your case. They was sending the same response to my lawyer and congressman and for all my inquiries about background checks this is just a diversion to win time. Good luck to everyone
María mDec 26, 2021
@Dolan MD “ so what happen after the second interview? you mean all our cases are denied that’s why we are still waiting ? because I kind of have an info pass appointment and she told me the officer hasn’t made a decision yet , she said it is not denied or approved
Waiting PatientlyDec 26, 2021
I’m not sure true how that is because I see cases taking years here and getting approved. I very rarely seen a denial and if there is… they win in immigration court
call me BlessDec 26, 2021
@marie Del Mar Montano I ask my congressman to follow up with USCIS so I can know what's going on with my case .I think it was the best that I could do .
call me BlessDec 26, 2021
after my interview I did sign my certificate for naturalization and the officer said I was to get results in 2 weeks ,in 2 weeks time I received RFE I responded in less than 2 days and it was received, all uscis told me and congressman that my application is now going under require background check.
A SDec 26, 2021
Dolan did u get a reason for denial
ben RosemyDec 26, 2021
same thing to me , one year after interview
A SDec 26, 2021
@ Ben what’s ur story ? did u raise service requests ?
María mDec 26, 2021
@Waiting Patiently . have you seen pretty much all the cases being approved after that long waiting ?
Waiting PatientlyDec 26, 2021
yes that’s why I’m not sure what the prior comment was about. There are cases being approved from 2010 on this app people posted like a week ago and on some off chance you do get denied, you get a lawyer. unless you commit some unspeakable crime you guys will be ok. Don’t stress out, Covid times are double, triple. background checks take waaayyy longer.
María mDec 26, 2021
but why those kind of background checks? you mesn it Can take up to 10 years of waiting ?
call me BlessDec 26, 2021
with that I don't know ,uscis will be the best person to ask dear ,I'm just praying for the best 🙏
Waiting PatientlyDec 26, 2021
I think some cases take longer due to processing times on the type of case you have and whether a citizen or PR is ur sponsor etc but I think the actual background check delays have to do with covid delays. Less staff, closures etc
María mDec 26, 2021
but not all the cases are delayed that’s the question , my friends got approved right after the interview
liz willsDec 26, 2021
one year ? omg is is marriage based ?
Waiting PatientlyDec 26, 2021
that’s true but did ur friends apply the same time as you? my green card took like 4-5 from the day applied, uscis rfe us for stuff we already sent so sometimes they lose things. Now I have a case to remove conditions on my marriage based green card… we are still married, have a kid, lots of proof and those cases take 10-16 months due because uscis is so busy. The truth is to remove conditions shouldn’t take 4 times longer than my intial card which I got 7 months before Covid hit but due to covid there are delays. For background checks maybe they are waiting for word back from ur country. I think it’s a covid delay
María mDec 26, 2021
yes, same time as me . yes , marriage based
María mDec 26, 2021
do they always check on people’s country ?
S NDec 26, 2021
PD , August 2020 Interview 11 may 2021
still waiting for Approval
the interviewer told me the same thing the will have to run my background check . I submitted an inquiry a week ago Let’s see what will happen. by yhe way this my second time filling I was denied the first time.
María mDec 26, 2021
@SN i don’t get the last part . were you denied ?
liz willsDec 26, 2021
I’m really hoping I don’t have to wait this long for a response . it’s been 2 weeks since I did my interview and nothing
Waiting PatientlyDec 26, 2021
@maria was it before covid or after covid. ur interview?
María mDec 26, 2021
during
A SDec 26, 2021
SN why were u denied earlier
Waiting PatientlyDec 26, 2021
I think it’s covid related delay. I keep seeing peoples post about waiting on background checks lately but I never saw that a few years back so I wouldn’t worry too much. uscis is just busy and slowed like every other sector but I don’t think they are heartless people just trying to make you miserable. if your case is marriage based, u love each other and are together… why would they deny u?
María mDec 26, 2021
yes , that’s right we are together and happy

when there’s a delay of over 120 days there are so many things you can do and the fastest action to take is to threaten a mandamus. that’s to threaten to sue them for delaying to take an action on your interview. I don’t know why y’all who have waited over a year or even a year still waiting. when you threaten to sue them, they immediately give you a response. which is either an approval or a second interview. don’t wait on them because they will waste your time. get a good lawyer to threaten to sue, not sue yet tho. when you threaten to sue they will respond asap. trust me they know what they are doing. there’s a WhatsApp group for people waiting for a decision after interview. my interview was 33 days ago today and no response. y’all can join the group so we share experiences and advice on what to do.

María mDec 26, 2021
@kings Wifey did you threat them and they respond ?
honi roniDec 27, 2021
I have same issue. I have done several SR, a congressional inquiry and received same response…pending background check. it’s almost a year after our interview and lawyer says I should wait till it’s exactly a year to file a mandamus. Should one wait one year to file one? Also the case is still within processing time.
María mDec 27, 2021
@honi roni , for me i think I’m going to wait until the case is outsite normal time . what else does your lawyer say ? does he say how long after the mandamus they respond ?
kings wifeyDec 28, 2021
@marie my sister waited after 120 days to file a mandamus and they responded in a week. they gave her a second interview notice. which is the stocks interview. they went for the interview and were approved on the spot and the green card came in 1 week. the longer you wait is on you not them. Because they even say contact them after 120days if you don’t hear from them
@honi some lawyers just try to buy time for them which isn’t bad but you can definitely file a mandamus after 120 days of interview. don’t wait too long because it’s either an approval or a second interview.
María mDec 28, 2021
@kings Wifey. I’m assuming after you wait almost 2 years they won’t call for a second interview.
