Yes, the petitioner must fill out I864 even if they are unemployed or have never filed taxes.

@Mr Nobody There is no additional document to support her I864 if she is unemployed. For joint sponsors, additional documents are W2 or 1099 and 1040 or a tax transcript.

@Mr Nobody honestly I think that’s a red flag. the purpose of the I864 is to show that you have someone to take care of you while in the states if she has no earnings then she can’t take care of you. they need tax forms and pay stub to show that she’s making money so if she’s not she’s not qualified

@Mr Nobody they declined my case for not sending the most recent taxes of my husband who is citizen. even if we had a sponsor. so send the taxes for the past 3 years. even if she is not making enough.

the lawyer told me it will be ok withiut his taxes and it was not. now i reopened the case but it delayed my whole case a year or more. and i’m still waiting for a decision after I reopened it. so do not apply without your wife’s taxes. go to an accountant and file or file online poverty level etc

and as for the sponsor send past 3 years taxes, w2, letter from employer

@A L my husband is paying taces he just didn t file back then for the last year. they will ask for rfe or decline if you don’t send the taxes of the american citizen. those are mandatory

all american citizens even if they live on a different continent have to file for taxes. uscis will not aprove the case without the taxes. even if you have a sponsor. believe me, i went through a denial so I totally know what I’m saying

@Mr Nobody the law requires a sponsor to prove an income level. with no income it’s gonna affect your case

me and my wife filled together last year and I recieved the RFE for I 864, her mom said she will help me with the sponsor letter . my only problem is my wife didn’t filed her 2022 tax it’s that gonna affect us, but the uscis have our last year tax.
