hi i am on the same boat since april 9 2021 when to the office and they tell me the same two months and still waiting but the guy who interviewed me tell me will take maybe one year i fill up some paper to but still waiting

my lawyer said will take up to one year or more because they have a lot cases

i when there to see if they can put the stamp in my passport to travel but they tell me they can’t do that for me

so ur not waiting for them to request ur file to adjudicate it.. u just have a problem in the names ?

they tell me two waits to month and i will get some news but still waiting when back again and they tell me the same wait to months and last time i when there the lady tell me i can’t not make another appointment till i get some news from them so still waiting

@A. I don’t think they are gonna be helpful my concern now is to know how long actually takes for uscis to receive my file from the dhs… because if it’s gonna take one year like some people say that would be insane and i have to find another way I can’t wait one more year

with congressman they will make an inquiry on the status of your case and they will feel the pressure. lawyers won't do much.

I know u r in the same boat too but do u have any information about how long it takes for uscis local office to receive my file from the dhs because some lawyers and some people say different things like 3 months 4 or 6 and some say one year which is crazy!!! and the uscis keeps telling me wait 2 months over and over again…. I wish i never agreed with my lawyer to take that route I think it’s better if we sent the termination letter directly to the Texas service center or file aos again or go through the aos with the immigration court all these routes could be faster than waiting for the local freakin office to request my file from the dhs

I can't really tell since it's at their discretion. Atleast what I know my I-130 was taking long to be adjudicated so I reached out to the congressman and he put on them pressure to adjudicate. He kept on making inquiries every other month. Emma and calls were not helpful

maybe that's the reason why my lawyer advised me to wait until the I 130 approve and then ask the judge to terminate my removal and send my adjustment of status application to uscis along with my termination letter. because that is very stressful to have to wait for another year judge to have my file transfer

if i did know that it could take up to one year to transfer my file I would never ever take that route I thought it could take three months like my freaking lawyer told me and it’s already over three months now and still nothing

if u feel like the fee won't hurt. if I was u I would reapply and send everything in with my termination letter and with a cover letter explaining why you choose to send in a fresh application so they could just forget about the one from dhs and start working on your case cuz one year is really fucked up

it’s blowing out my mind when I think that it could take up to a year for uscis to receive my file and I can’t find any resources on google to know how long actually it takes because I talked to many lawyers and every one say something different 2 or 3 or 4 or 6 months, year

hi i when to final court on 12-03-2018 and i just got the paper cout on 04-09-2021 waiting all this time for the papers now they said i have to wait another year or maybe more to get me paper

@🤔 that's the same thing my lawyer plans to do, I-130 approval, termination of case in court then file I-485 accordingly.

that's right because if u send i485 in now they will send it to dhs and then after the i130 approve they will take forever to send that i485 file back to uscis

you guys are gonna have to fill i485 application with Uscis first to pay the fees ( after i130 approval) then you are gonna take the i485 receipt with the i130 approval and the other AOS documents and send it to the court and the DHS with motion of termination so the immigration judge can terminate ur removal proceedings ( so there is no way out for not sending the AOS package to the immigration court and DHS )

listen when you are in removal proceedings you can only file i130 with uscis after it approved u can either choose to continue with the court by filling for i485 and i765 with the or u can choose to terminate and file your green card with uscis. when you are in removal proceedings you are not eligible to file concurrently just like regular fillers u only eligible to file i130 only

that's what I was told by my lawyer who have been dealing with deportation case for decades but some lawyers don't know or they just wanna make the filling fee money with people and encourage them to file everything with uscis before the i130 even approve with is a bad idea because uscis won't even look at them because you are in removal proceedings they will send everything to dhs and only keep the i130 because that's all they have jurisdiction over because u in deportation proceedings and then when they approve your i130 they will ask to request for your file from dhs and because so many people are in removal proceedings your file might be lost or they will take a while to find it and send it back

actually u can file the both but the uscis can’t adjudicate ur i485 until ur removal proceedings get terminated….. so they are gonna administratively close ur i485 and if ur removal got terminated u can send the termination letter and motion to reopen ur i485 with the uscis to adjudicate it without filing new i485…..and if ur i485 still pending with uscis while ur removal got terminated u can either send the termination letter directly to uscis or u can get infopass appointment and the uscis gonna request ur file from the DHS

if filed i485 with uscis while i was still in removal proceedings and that’s was 13 months ago …. my i485 still pending with uscis and my case status latest updated says that my case shows that fingerprints were taken…. when i called the uscis right after the termination the immigration officer told me that ur i485 still pending and we didn’t take any actions because u were in removal proceedings but now ur removal got terminated so am gonna schedule infopass for you and ur uscis local office will handle ur case

oh well that's great to know and I'm gonna find out more about this because i wanna start nursing school the school says if I can show them that my green card is pending by showing the receipt and everything else I can start but because i only applied for i130 I was waiting until it approved if that's the case I'll send my case in next week and use the receipt to start college. thank you man

@🤔I agree with you. that's what my lawyer stated in the contract we signed. The whole procedure is correct USCIS I-130, Termination and then AOS with USCIS if granted. If not granted then AOS with Immigration court.

thanks god… received interview appointment letter from the uscis local office and the interview will be on January 31 also my status didn’t change on the uscis website because uscis local office requested my file that in the dhs not the one in the uscis service center

same boat but i filed again with new application in 2020 and i had interviewe in 2021 i request officer to converte my application to waiver now waiting for decision from last 4 months

since you had your interview on 31, how did it go? my case is same like yours. got terminated in October on behalf of i130, now just waiting for the interview, haven’t heard since ,I called the USCIS yesterday, now I’m waiting for the tier 2 officer to call me, plz share your experience for the interview thank you,
