Oh when did they approve your Vawa and did they request for your medical as yet?

approved since Jan 25 last year, submitted rfe 5months after as requested

Oh was your RFE medical, and also did you file a new i485 or you held old one in Abeyance?

i am currently there and they only said i have to wait as everycase is different. i did info pass basically because of my i485

@Krish90 I know but you know I did a new i485 with my i360 and I have a pending i130 and i485 which is yet to be withdrawn, but do you think having those two cases on pend could make me wait a longer time?

i am nt sure, i did a new i485 too, i think u need to have withdrawn them prior to submitting a new one

@Krish, your i360 approval definitely on its way soon as your travel parol shows you have no reason for denial, so you have 100% approval and you will get it soon brother

@Krish, But still you have a ground to have i485 still pending remember so I believe it will all work out approved 100%

hi all. lots to learn here and I am glad to be in the community. May I have one of you revisit what you meant by a new I485 while filing VAWA? in my case, spouse withdrew I130 and trying to annul marriage. i gotta fight it with divorce. We just submitted my case. however, my attorney decided to switch current 485 from Marriage to VAWA since decision wasnt made yet. Since i didnt start a new 485, my case might be even messier i suppose?

@Tete nope your case won’t be messier it will only get messy if you allow annulment rather than divorce. i485 was held in Abeyance for you which will resume once I360 approved which will replace i130 so they can have a ground to decide your Adjustment of Status on. Sometimes people like me file a new one and leave the pending i485 so once one is approved the other will be closed out since benefit will be received through other means

Ahh. This makes more sense. Abeyan e is the legal term. in your case it leaves your optiins open. That is good to know. Kenny, I think now that my case has been filed after 3 months of dedicated work while fighting 2 temporal restraining orders since I was going to ask for a divorce, I should invest more mental energy to knowing how I can fight the annulment.

@Tete Exactly, just make sure you go to courthouse and file a divorce yourself because I did file my divorce too before I apply for VAWA so just that way you can be two step ahead of them because they knew with annulment is just to say the Marriage never existed
