@Sam N, thanks for your responses. Please can you provide further details? When will someone on H4 with I485 EAD and SSN considered to have switched or abandoned the H4 status?

After approval of 485 you will convert there SSN on the greencard status and even your own SSN (primary applicant) will need to covert it in greencard status. My kids also got approved EAD last week and yesterday me and my husband got direct 485 approval while waiting for kids.

Our 485 received on 13 february 2024 but we got our biometric letters late in mail when it was already missed. So after rescheduling our kids got next date on 12March but we did our biometrics on 6May 2024.

Our kids then got EAD on 13 June and we got our 485 approval yesterday on 17 June but still waiting for kids 485 approval.

Overall it took almost 4 months but Alhumdulillah wait is over now. We are on Eb1A. Hope you will get your approvals soon.

@Sam N, quite a process! Congratulations once again! The kids approval is just a function of time...... My situation is a bit funny: I submitted my AOS based on pending EB1B (though I have an approved EB2-NIW). This is 9 months+ and we are still waiting for our EB1B approval (No RFE, nothing from USCIS). We have contemplated requesting for Change of Underlying Basis (EB1 to EB2) but have kept hoping that we are very close to the petition approval 😀.....but nothing. The issue is that USCIS keeps moving the processing time backwards. When we submitted, it was 4.5 months, now it is 9.5 months. We have been praying but not sure if switching or waiting is the best option. God have Mercy!

@mr tp, thus is a perfect response. That is what I am thinking......since their GC EAD has been activated via the issuance of an SSN. Once they leave the country, can they only re-enter with an advanced parole. Is this correct?

@Rijo Rijo thanx..we also got NIW approval last year with PD 21 March 2023. As it was not current so we opt for Eb1 A. Hope you will get positive response soon.

right, Rijo. if you left, and re-enter, it’s 100% on AP. the border patrol can decline you, too. that’s my firm said. we arr on the same page. my AP is for backup only.

yes it’s been approved in October 2023 and PD is 1st sep 2022

@faryal faisal, oh really. I thought your spouses EAD was approved few hours after yours? Couple of persons in this App reported that their spouse's EAD was approved few hours after theirs. I suppose that the person handling mine might be handling yours too! Fingers crossed we get some update soonest.

@shan ye, to the best of my knowledge, no! EAD issued to kids is pretty much for tax purposes unless you want to send your kids to work 😉

@M A one of the child got approval after 2 days and the other after a week

@M A No l didn’t contacted Emma as everyone was telling that it’s not a big issue. Once primary applicant got approved then children usually got approval soon
