Hi All, I am a GC holder and in US , I have applied for my wife’s from I-130 she is in India and never visited US. it’s been 1.5 years and no update from USCIS!! Can I apply a tourist visa for her? Will USCIS approve that or no? has anyone done that before ? thanks

if she has a travel document provided by USCIS, she can visit you… if she doesn’t she shouldn’t. You can leave the country when you have a pending case with immigration. the only time you can leave is when your case is approved and you have your green card in hand or when she has a travel document

@Dimi Bam this is true only for AOS. In this case, OP's spouse is doing consular processing and doesn't have any travel documents. @shiva rally it is highly unlikely that your spouse will have her visa approved because a tourist visa is given out to foreigners that can prove no immigrant intent. It would be hard to do that for your spouse.

hi Shiva, my wife renewed her B2 visa while her i130 was pending. She received with no issue. it was in 2023. Good luck.

don’t file for tourist visa, it’s better fiancé since you’ve filed I-130
