Green card finally approved! 💚🎉
I wanted to share my experience with you guys! I first applied early 2019 and had my I 140 denied months later, so I reapplied early 2020 and again they denied my I140 months later. So, early of 2021, I applied again (3rd time) and never heard from them until Dec/2022, so almost 2 years. I received a RFE; in the mean time from 2019 to 2022, I was basically renewing my EAD so I could maintain my status and continue to work. Back to RFE: I was so exhausted and tired of this whole process of my I140’s being denied… but I had a goal!!! So I worked really hard to prepare all my documents and everything they asked. I received 10 pages of RFE. I used all the time they allowed to respond (almost 5 months). I submitted everything end of April of 2023 and in June I finally received an approval of my I140. I couldn’t believe it! so happy! after that, everything went well and really fast. I received a RFE for medicals in the end of August (on the letter they asked me to send everything to them asap so they could still consider me for this fiscal year that ends now in the end of September). so I sent my response on September 5th and on September 13th I finally got my green card approved without an interview! I’m so happy and I decided to share my experience because anything is possible. I could only get an approval on my 3rd time trying! btw, I have a lawyer, didnt do by myself! but as you know, most of the work is up to us! So, dont give up! it took me 4,5 years since I first applied to finally get my green card approved!!!!

@Natasha Ap (Medicals RFE) they asked me to send to Montgomery -AL. Now, the RFE I received last December for my I140 I sent to Nebraska.

@g c yes, my EAD card was always current. I requested the renewal of my EAD and Parole within the allowed time so I wouldn’t fall out of status.

wow. congratulations, buddy. As someone who was also denied in January 2023, I have a question. When you got each of the denials, on what basis were you able to reapply as I understand that you have to be on a non-immigrant status (B1/B1/F1/H1) in the US for you to apply from within the US? How were you able to keep reapplying without leaving the US and eventually got the green card?

@FlyHigh ❤️ when you receive a denial of your form I140, you can reapply within the time USCIS allows you. When this happened to me, the EB2-NIW was still current. So I was able to apply all my forms (140, 764, 131 and 485) concurrent. doing that I was maintaining my status active and consequently having my work permit renewed. My previous status of F1. I had all the help and knowledge feom my lawyers who help me during the 4 years I was trying/waiting to be approved.

@D Flex yes, it’s a new process. the only thing is the same is your A number. my lawyers did that for me .

@FlyHigh ❤️ I don not think he maintained the F1 status throught the 2 denials. he said in his respond that "his previous status was F1" he should clarify to us about how he was able to maintain status throughout

@Tolu A , that part of @V S explanation is still unclear. I remember after my first denial, I was told that without a valid non-immigrant status like F1/B1/B2, I can't apply for another eb2.

@FlyHigh ❤️ I have seen cases where pple with pending Asylum cases got adjusted. and also I have someone with R1 visa got his green card via NIW

@Tolu A and @FlyHigh ❤️ my status was ok because I was always filling concurrent. My laywer said the most important part was to re-file within the deadline uscis gave me and that the I485 was the form that would keep me in a good status as long as I was filing before the deadline. so basically I had 3 forms I485 pending even though some of my I140 were denied. so my understanding is that since I always filled all my forms together I never fell out of status. USCIS would never have approved me if in any moment I was out of status. As long as I had an active case (I485) my status was ok regardless my I140 being denied . I know it is confusing but I also had several friends in the same situation and they did the same thing. re-filled all their forms. I’m pretty sure this is something normal for lawyers and they go through similar situations a lot with their clients… so, yes, My previous status was F1 and I only requested the DSO to cancel my I20 once I was halfway through my very first case… just to be safe.

@V S were you on F-1 OPT (Stem)? Had you utilized all your OPT years? I have filed concurrently but did not get work permit. i had to go back to school to remain in-status and for the school to issue me CPT before I could work. Please how did you convince USCIS to issue work permit based on filling concurrently.

@Luci Oliveira I always had the advanced paroled ready to be used (approved with the EAD), but I never travelled overseas, so never used.

@V S I'm in the same situation now, but I have a question for you. My I-765 was approved today but my I-140 was denied 10 days ago. my lawyer said for refil too, but for now he make a TPS For adjustment status while he introduce again of I-140. so, what happened if you get approval of your EAD with you I-140 Denied?

@D Flex @Moises Rivera I applied for the 3rd time in 2021 where everything was current. So when you apply to 485 that gives you the ability to requet the work permit/parole. each time my I140 was denied, I immediately Reapplied (140, 765, 131 and 485). The work permit/parole is always linked with the 485. but remember , I last applied in 2021. even though my I140 was denied the other two times, I always had a pending 485 (actually 3 pending forms) because I always reapplied as soon as they denied, so I was always able to request the renewal of my work permit, that allowed me to not be out of status. My lawyer said the form 485 is about your immigration status! So having a 140 denied not necessarily means you are automatically out of status. all you need to do is to reapply asap (within the time uscis allows you to). but again, I did it in 2021. I know at this moment , the dates are not current . so if you have a denied 140 things would be a little different. when the uscis officer stated to work on my case, I had all the forms filled already (485). they sent me the approval with a note that they would be working automatically to Adjusting my status withou me having to wait for them to approve me to send the forms… So, they approved my 140 in june 2023 and started to work on my 485 right away since I filed in jan 2021. so my dates were current! I know it can be a little confusing to understand that but basically it is all about the dates being current. Lets say if my I140 was “denied in June” instead being approved, I wouldn’t be able to apply the forms 485, 765 and 131 since the dates are not current, only the 140, which means I would have to stop working and wait for my dates to be current to apply(after having the 140 approved) and wait for them to review and approve.

my i140 has been approved. @Dozikaho on telegram helped me with my RFE response
