I have a question. a friend of mine & her husband been married for a year now & will be 2 in aug. . but the husband was a f-1 student. then long story short he wasn’t able to pay his tuition which ended up to immigration & immigration had sent a removal “deportation letter” which has been rescheduled for next year in october. can my friend file 130 & 485 for her husband while he has that deportation letter before scheduled court date oct 2023. or she has to do something to stop that removal proceedings first before filing both 130&485. i suggested a lawyer but due to funds ectt , can’t afford a lawyer as the whole process with immigration already expensive. Also the husband currently applied for tps & work permit “821 &765” & both case is being currently reviewed.

also the wife was waiting on her naturalization certificate & supposed to get it this week.

"I am not a lawyer". they have to hired a lawyer and ask for a payment plan. they can file the I-130 and I-485. If the I-130 is approved, you ask the Judge to cancel the removal proceeding. good luck

omg I’m scared! I changed from j1 to f1 but i would like to cancel change of status application since I’m getting married in Feb. idk what to do if i get that letter

no. my change of status application is pending.they just sent RFE but I’m getting married next month and would like to withdraw. what happens if they sent me a deportation letter?

i am on j1 but J1 Aupair. i looked into it on giv website and on my visa. i am not subject to two year rule

whatever the situation u R once U married with a citizen you can always file the I-130, for the rest he has to contact an inmigration attorney so that he can request a cancelation of removal by a judge. and for the college I don't know how he will deal with it
