GREEN CARD APPROVED (with DUI and Battery)
Hey everyone, I just wanted to share some amazing news—I’ve finally been approved for permanent residency! This journey has been so long and honestly really tough, and there were times I thought it would never happen. My case wasn’t easy at all—I had a DUI in the past, and a few years later, I was arrested for domestic violence, even though I wasn’t guilty. That arrest still stayed on my record, and it made everything more complicated. What I’ve learned is that a DUI or even a battery charge doesn’t automatically make you ineligible for permanent residency; it all depends on the details and how your case is handled. The best advice I can give is to work with an attorney—they know how to guide you through the process and fight for the best outcome. I used to call uscis minimum twice a week, every time I called them I always requested a ONPT (outside normal processing time) , there were times where they would do it as others they didn’t. I guess that was one of the factors that really helped me to get my case going. According with your timeline your case is most likely ONPT, so I def recommend you to do that and if you are, just continue to do it until you get an answer @lulu 369

Andres Marino, how do you go past talking to the automated machine when you call USCIS…I have had no luck calling… my pd is Feb 2022….130 approved this Jan, 485 pending

the thing is when i call they say it’s processing normally 🤦‍♀️ and I have to wait , I contacted a congressman then he told me that if i didnt get any answer till February they will help , @Andres Marino

@Mmmm gggg you’re gonna call once you pass the annoying automated machine. you’re gonna say case status, it’s gonna ask you for you case number right away. say I lost my receipt and the machine will have you talking to a live agent for default

i had an interview appointment on the 25th of june when me and my husband were waiting our turn an officer came told us that they cant pull out the file due to a technical issue ,, and that they will contact us to reschedule if we need one 🤷‍♀️ since that day there is no update at all and they didn’t reschedule us @Andres Marino

@Champy quickmath I had to sort things out regarding the DUI, complying with the court in order to clean my record. that is very important to have all the documents that proof your compliance and have them attached with your application if you did so awesome but if you didn’t I’ll recommend you to have them ready for them. now regarding the battery it pretty much depends on each case if nobody was extremely hurt and you got it dismissed then you’re fine. just have to be ready for a long wait and have record of everything like police reports, and letters of disposition for each case. they’re gonna ask for all of that. trust me if you’re on top of your case they will take it into consideration when taking a decision. (and that’s speaking from my personal experience)

@lulu 369 regarding your case processing normally that’s bullsh-@/&- and don’t get me wrong. but like I said I usted to call these people twice a week. and they will always come up with something different. there were weeks where I would call 8 times just to have them filling out tha ONPT for me and trust me they would do it. just gotte be patient and try to connect with them in order to help you.! Now regarding your interview that is very very strange. I would recommend you contact them and asks them about it just to make sure that everything is fine. as well as finding legal advice because that shouldn’t be like that.

congratulations @Andres Marino I do have a question I was arrested for aggravated assault and battery. but all the charges were dismissed after they find out I was not the aggressor but my wife was the abusing one. this was 2019 I received and RFE from uscis to provide them all the arrest details and any information with the arrest

as far as I’m concerned even though the case is dismissed, the arrest would appear on your record. unless you expunge it. (which is a whole other story). if you provided uscis with all the records. as letter of disposition, police reports etc… most likely they’re gonna have you to do an interview so they can take your declaration. the problem with cases like ours is that they’re going to delay them until they 100% sure that the beneficiary is good to go. it’s almost as if you were on some kind of probation.

@ypiron busca el tiempo de procesamiento en tu ciudad y estado para la I-130. una vez tengas esa información compárala con tu tiempo de espera si se acerca a la cantidad de tiempo estimado de uscis o si sobrepasa. te aconsejo que llames e insistas. pero ponte enfrente de tu caso, llamas 1000 veces si lo tienes que hacer y pídeles que te hagan un inquiry a la oficina que tiene tu caso, para que tomen acción. basándome en tu PD estás más que pasado de tiempo!!

you scared me 🤦‍♀️ the congressman contacted them in October and they told him there is technical thing blocking them to pull out my file, and they said they will work on it, he called to check two weeks later they sent him the ai reply that they reply to everyone,, thats when his office told me to wait till February…… i kept calling them from my end till i finaly received that my interview was canceled in December 😂 imagine from june till December….. i saw two pple have been in the same thing in atlanta feild office @Andres Marino and please if u have any advice let me know ❤️

@OLAMONEY STILL WAITING GOD no I wasn’t. since the case was dismissed, I wasn’t gonna spend any efforts on getting it expunged. I just collected all the info that I mentioned before, proving the case was dismissed and gave the declaration to officer in charge of my interview. if you get to that point like me, make sure you’re honest about it, tell the officer everything exactly how happened.

congrats 🎉 please how would I contact my congressman because my i130 says nothing ouststanding since November 2023 until today and when I call USCIS via Emma they said that it still normal processing that I should hear from them before Jan 6, 2026 if not I can submit inquiries. please any advice

@Arinze A try using this (https://www.house.gov/representatives/find-your-representative) website that a girl friend of mine used before to find out about her congressman. Now regarding your outstanding court, as far as I’m concerned in order to get any immigration benefit. You must have a clean record; what I mean by that is no pending courts or any related legal issues open. I would recommend you to find legal advice so you can be instructed on what to do and expect, when uscis reaches out to you. Stay put and be positive if you do things right as well as being on top of your case; you will get that approval! 💪🏼
