@huber Manu I have traveled in the past. when you enter on AP the H1B status is void. For employment you need to provide EAD and your employer will submit new form I9

one more thing - avoid any route through Europe. middle east or turkey Japan is ok

how did you expedite the AP? I think, I am in the similar boat. My visa stamp is expired and having H1B approved. I have a planned international trip and need the stamp if AP approval doesn’t come before the trip.

how long does it take for you? did you provide any justification document?

you have to wait for atleast 6 to 8 months after filing.. if no response you can say I need to expedite in chat.. if you are lucky they will allow you to speak to tier 2 officer

@huber Manu you can use AP if you don't want to go to hassle of stamping. if you have drop box and able to get stamped then do it. There is no issue with entering AP as it's also legal but only issue is they are doing some additional checks at some port of entries and may keep you waiting longer

It is a gray area what will happen to your H1 when you use AP to enter - as per majority of lawyer it won’t void your H1 status. AP is just for travel - your work authorization will remain H1. Better to be transparent to the company lawfirm.

@david K once you enter on AP the I 94 status gets updated to DA which is basically telling you entreed on AP. the H1 as such doesn't get cancelled. if you have valid petition and enter again on H1B and your I94 and status again gets updated to non-immigrant visa. hope it's clear now

basically I 94 determine which status you are on so be careful. once you enter on AP you need to update your employer with EAD details so they update I9 information

entering on AP does not voids your H1 status until you do recertification of I9 with your employer using your EAD. Entering on AP keeps your H1 status valid.

@k b when you enter on AP your previous Non Immigrant H1 status is void as it is set as Parolee. your H1 remains valid but legal status changes. there is plenty of information available online on this. if you again travel and use valid H1 visa for entry then status goes back to non immigrant H1 again
