Govt filed a motion to dismiss my WOM — any advice?
I’ve been waiting for about 19 months for my I-485. I filed a WOM back in March. The govt missed the first deadline, so my attorney served them again.
Now, the government has filed a Motion to Dismiss (MTD). They’re arguing that 19 months is not an unreasonable delay and pointed to the current processing time of around 32 months.
Has anyone been in a similar situation? If I oppose the MTD and the judge grants it, what happens? Would it be better to voluntarily dismiss the case now and possibly file again after another 6 months?
Any experiences or advice would be really appreciated! 🙏

the wait time will keep increasing every month. maybe in 6 months, it will be 40 months or 60 or even 70. if I were you, I’d keep fighting it by filing a motion to oppose

fight them the timeline is keep increasing every month and your lawyer can tell the judge during hearing that the time is keep increasing every month

fight it and try to show what the ProcessIng times were when u filed and how much it has increased and continue increasing

@Amy Tree 2025.5 granted by immigration judge, 2025.6 filed 485, 2026.6 filed won, August government attorney contacted me and said my waiting time is so short. the processing time is around 33, nine is only 14 months.
