Got This Response Back From The White House Today While Contacting USCIS
We understand your concerns and will give you accurate information and guidance. In your letter, you state that your spouse's Form I-130, Petition for Alien Relative, has been pending over 1,300 days and your Form I-485 has been pending over 777days, with no updates from USCIS. You would like assistance from the White House to help expedite your Form 1-485. The Special Cases Unit has been in contact with the Queens Field Office making them aware of your concerns. The Queens Field Office has informed us that unfortunately, there is a delay in processing your Form I-485 because they are still working on the required investigation into your background. Once they complete the investigation, they will move forward with your case. We conduct security checks for all cases involving a petition or application for an immigration service or benefit. We do this to enhance national security and ensure the integrity of the immigration process. All applicants applying for a U.S. immigration benefit are subject to criminal and national security background checks to ensure they are eligible for that benefit. These background checks require time, resources, and patience, and we understand that the process is slower for some customers than they would like. Because of that, we work closely with the Federal Bureau of Investigation and other agencies to make sure we can complete the background checks quickly as possible. However, USCIS will never grant an immigration service or benefit before the required security checks are completed, regardlecc of horn long those abecks take.

I had contacted my senator and this is the same answer they gave me but it was from a different field office, this response is generic and it is not true, you may proceed to file a WOM lawsuit, do it assp. They give this answer to have an excuse for their backlogs. @Lord Is My Shepherd πŸ™

assuming that you don’t have any background issues as they claim, consult with a lawyer about filing a wrot of mandamus lawsuit, where the court makes uscis to make a decision usually within 50 days. But if the case is actually going through background check then they might deny the case, always consult with a lawyer, they usually charge $5k for this lawsuit.

@Lord Is My Shepherd πŸ™ no my case is pending for 300+ days now, they have received my rfe in august and my case has been transferred elsewhere in a non local FO, I will be waiting until it marks a year since I filed then will proceed with a lawsuit, your case is outside of normal processing times, no case should take this long.

if your case is more than processing time just sue USCIS you will get a response from them in two weeks maximum. .

I contacted my congressman and this is the same answer we got we are waiting since December 2021
