Is it the same wife that is abusive? if yes, don’t discontinue your VAWA, but allow her to file for you. And wait to see the outcome. This is just my opinion/advice

I agree with@AUG 22...what if she changes her mind again? I would stick with VAWA!

@Champy quickmath you got prima facie determination which means you meet the necessary criteria to file.

I would advise you to stay with VAWA because if you go through marriage again then USCIS will scrutinize the hell out of you to be sure that it’s legit for real and it will take more time almost as if you are doing VAWA. also anything can happen between you and your wife and when things go south you will be back to square one with no options or alternatives. you will be back to starting all over again from the beginning. so my advise for you is to be patience and keep it going with your VAWA and continue to pray. already you got a PF so that means you met the requirements and you are good to proceed with VAWA so stick to it. if she truly loves you she will wait for you. well that’s my take. the ball is in your court my friends @Champy quickmath

@Champy quickmath yeah, I would stick with VAWA. There's a reason you filed in the first place and as @bolaji imran stated, if she once again changes her mind later, which she will, then you're out of options. You don't want to send too many applications to uscis or they will scrutinize you very closely. VAWA will take a while but wait. If she truly came around then great, and the wait won't be torture, but for now you'll have a work authorization and independence nonetheless. Her changing her mind now may just be a power play

@Champy quickmath discuss with your Attorney. I heard that one can have multiple applications, I don’t know maybe it’s true or not. Though, I could inferred that she is deceiving you and playing with your emotions, but continue to be a good spouse.

@AUG 22 I know of cases filed before and then VAWA so the priority date would remain the same as the original application. I'm not sure filing for VAWA, and then filing with the same spouse makes sense. Either your spouse is abusive or not, but a second application with the same spouse will raise eyebrows, in my opinion. And if her filing doesn't go through, how could you possibly go file VAWA again? Just go with this application and don't let her know you filed under VAWA
AUG22 GodHaveMercyJun 6, 2024
@Kerry S I agreed with your suggestion. it’s better to be consistent

@bolaji imran @AUG 22 I already have an approved I-130 since 2021 that's y and I know it's gone take a shorter time to get my green card if she sponsors me

@Champy quickmath
Most of us @Kerry S @bolaji imran @jp web gave you the advice of not pulling out of your VAWA with detail explanations at to why you shouldn’t.
If you still want to pull out of VAWA then go ahead and do it. like you said your I-130 approved previously and you think you will pass your green card interview with flying colors.
One more thing, if immigration suspects a fraud you will be BARRED for life.
Let us know how it went. Good Luck.

@Champy quickmath I'm confused and clearly we're missing something. You have an approved I-130 since 2021 and no movement on the case? No interview scheduled? It's just been sitting there for 3 years and then you file for VAWA, got that approved, so there's legit proof of abuse, but then you want to do what now? Outside of VAWA it seems you'll just keep waiting. You seem like you've made up your mind what you want to do so as @A T said, let us know how that goes. Best of luck!
