Got 485 approved (India PD 2021)
Finally happy to share that we got our 485 approved after about 6 months in the queue. - The case is actually EB1-B and we had ported from EB2 NIW with PD Aug 2021 (India). - During 6 months, the status changed to CRP near Sept end and stayed with NBC all this while. - No RFEs but bundled all form of extra proofs initially (like affidavits in addition to birth certificates) along with medicals - No other form of nudging (like senator etc). Just pinged Emma every 2 weeks to know if online case status is accurate Feel free to ask me anything and I ll be more than happy to help. Just focus on what you have in control and stay strong — there is a lot of luck and uncertainty in this process. oh ya, my AP application/fees turns out to be pointless

@J J local office wait time was 10 months. but again it is average of 80% all kind of petitions and not helpful except for raising SR. EB1 s are expected to be processed sooner. in fact mandamus suits are applicable just over 1 year for EB1 while EB2 or EB3 etc the lawyers recommend 20-24 months to elapse.

@a k please can you share more details on how to get a birth certificate affidavit if parents are in India ? should it be on stamp paper and who can notorize it ?

@a k - how do you chat with Emma to know if case is being actively worked upon. My I-485 application went into case remains pending status on Jan 22nd 2025. everything else seem to be in order. I-485J got approved on 23rd Jan 2025. is there anything I could do?

@saurabh gupta I just keep asking which location is the case file. I also noted my case went into CRP on the prior date of 485J approval. in fact all these 6+ months my PD was current so CRP was definitely not due to visa unavailability but it could be due to some internal system limitations as the note says in USCIS website. my guess is that 485J was approved by different officer and put us into this intermediate state until the actual 485 officer gets a chance to review/approve.

@PM, M I just got and kept it ahead of time since my birth certificate had name abbreviated for all (me and parents). usually affidavits are for late registration or name missing etc but I just kept things prepared. it was on a 100 rupee stamp paper and any lawyer in India will help n you out on this. I just asked parents to get this attested and FedEx me.

@PM, M This is standard procedure in all countries (India as well) and used beyond immigration purposes. Just that the seal and paper differs for notary. in this case it will be your parents attesting to the content in front of the notary. your parents and the notary will sign on the printed stamp paper. the notary will finalize with a rubber stamp. the content can be prepared by you and discussing with your us immigration lawyer. some law firms like Fragomen or BAL are specific with their format.

very similar timeline for me. COB- India. priority date- Sept 2021 (ported from NIW to EB1b) I485 filed on July 3rd, 2024. received card being produced notification on 01/27/2025. case was at NBC all this time. Emma chat revealed that it was transferred to El Paso, TX (non-local Field office for me) on 01/21/2025.

@a k mine as well in CRP from Sep-2024 and only thing I can think is this local office wait time as it shows 32 months for me. Due to this I am unable to raise SR too.
