Hi, I’m new and have a question:
How long do we have to wait after getting married to file for I-130 or we can file immediately? we are getting different answers since some people are advising to wait for 90 days while some are saying we can file immediately after getting married. Please advise

Your marriage is valid after consummation. After that you can start filing immediately

well, it depends. if you file immediately and you guys don’t have any solid proof that your marriage is legit USCIS will raise questions. that’s why there’s a 90 days rule. it’s to show you guys lived together at least 3 months after marriage and it wasn’t a rush for papers. You can file immediately, but get your proofs in order.

I will wait and please be sure to have alot of evidence that the marriage is real use that three months wait to get stuff together because u will need to send in proof of a sincere marriage

there is such thing to do immedietly ir not but u want ur case approve without any issues then get apartment lease together, utility bills, bank account, insurance and medical as well it takes time to gather n those are strong evidences to win the case so better wait and file it instead of rushing it

the 90 days rule doesn't apply to the situation after you're married my ppl.
the 90 days rule is for the person who just enters the United States and with the knowing intention of getting married just after they arrived.
if you are madly in love and u decide to get married after spending 3 month is the USA then get married and you can file your documents on the very next day. it's a bigger red flag 🚩 if you get married with the first 90 days of your arrival on your visiting visa.
