Follow-to-join within the US (non-consular) based on approved green card
- Spouse’s I-485 was approved last November. - My I-485 was submitted based on spouse’s approved I-485/EB3 unskilled (instead of green card/spouse) - Priority date is way back (2019) -My I485 was filed early June and was approved last week (3 months). No interviews, no RFEs So-called “following-to-join” because Spouse recently received green card and we married prior to filing the 485. which documents did you submitted with I 485 application as a derivative? can I talk to you ? my case almost similar to yours.

Every document showing my legal status within the US since my entry (797 notices, opt, i-20s) and of course Principal’s approval (I-140.485)/green card, and documents showing my relationship with Principal (marriage certificate, joint tax returns, etc.) I-693, and translated famil registry documents from home country (proof of birth).

my I 485 still pending. can I apply for my wife as a derivative aplllicant now ? she is continue her f1 status since 2022 December and my PD will be current next month. Should I wait for I 485 approval for her application?

If she doesn’t have any issues with her f1 status, yes she can file her 485 as soon as your PD becomes current, but I would recommend her maintaining her status if your case is complicated (with any possibility of getting rejected) and wait until yours get approved to apply for hers.
