Finally!!.
My journey started back in 2000 when I came to the US under an H1 visa which was renewed 2 times. The company did the sponsorship for permanent residency but the process was denied after 10 years of being in the US because the company was going bankrupt. I returned to my home country and 13 years later applied to EB2 NIW. After my previous experience I did not did not wanted to rely on a company but in myself. Applied on Nov 29th and got my greencard almost two years later. In my opinion H1 is not worth it if you are on IT or stem careers unless you lack of experience, there are too many ifs on that route.
Good luck to you guys, I am sure your road to green card will be easier than mine!

congratulations! could you please share how was your interview?
Eusebio MercadoNov 2, 2024
I had an interview. The uscis officer started asking me about my previous case, why was it denied, asked for evidence that I returned home on time after being denied. Asked if I worked here without having a permit. Asked for details about my proposed endeavour. I was well prepared with all the evidence thanks to my lawyer who did a mockup interview a couple of weeks earlier. At the end the officer told me I was approved and that it will take 2 weeks to get the cards. 45 days later I got the notification the cards were being produced and the case approved.

what is a proposed endeavor? please explain to me
Eusebio MercadoNov 2, 2024
the core of the eb2 niw is a document called Proposed Endeavor, it describes your trajectory, achievements and your purpose in the US, in it you should demonstrate to the USCIS why you are an asset for the US government to be granted the national interest waiver. with it you do not need a sponsor or an investment capital.

What evidence did you bring with you regarding what you are doing?
Bakhodir sultanNov 3, 2024
If you don’t mind me asking, how far in advance did you receive the interview notice? For example, did they notify you about the interview a month or three months beforehand? And how many days after the notice did you actually go in for the interview?
Thank you so much for sharing any details!
Best regards,

Evidence: Copy of diplommas, email communications with the attorney who handled the previous case. The agent also asked for my taxes from the last two years.
