FINALLY! After almost 2 years, GC approved
Hi all
Finally, I-485s approved for me, my wife and my daughter (12 years old). we are over the moon!
Here is the overall timeline. quite an odyssey
EB1-C (employment based - multinational exec/manager)
06 June 2019 I-140 submitted
04 May 2020 Request for Evidence
13 Aug 2020 I-140 Approved
01 Sep 2020 I-485/I-693/I-765/I-131 submitted
(received by National Benefits Centre Missouri)
18 Dec 2020 Biometrics taken for Wife and I
02 Jan 2021 EAD/AP Approved for wife and I
16 Feb 2021 Request for Evidence (self sufficiency)
17 Mar 2021 Daughter Biometrics Taken
29th April 2021 Decision - New Card is being produced for all three I-485s at same time
(Daughter I-131 never got actioned which is weird but don’t think it’s even necessary now!)
Can’t even begin to describe the relief to finally get this sorted. lawfully was spot on with the prediction of potential approval. it had said between 27th Feb and 29th May.
good luck to everyone. it’s a tough process to go through but a nice feeling at the end 😀

Wow, congrats! I am with NBC Missouri as well. I filled AOS a month after you, Biometrics taken 12/21 and I haven't even got my EAD/AP yet.

congrats @Dave A !!
did they request RFE for you regarding I-485 supplement J?
Jos SApr 30, 2021
@Dave Mine is eb2. May I ask - when you receive notice about I-140 approval, did it say where was the petition was sent to? My says it was sent to National visa center which I don't know why would it be sent to visa center if I filled for AOS within the US.

@A S first RFE which was against the I-140 was requesting more info about my managerial position abroad as well as our company’s ability to pay (despite being a FTSE100 🤔 company).
second RFE was against the 485 and was to request the I-944 declaration of self sufficiency forms for my wife and daughter only (although we submitted for all three) only for it to then be removed as a requirement a week after sending it all back after all the time and expense made to get all the things in order grrr. waste of time and money but I supposed it helped in some way because I think they are bound to make a decision within 60 days of an RFE response being received. no RFE was issued against the i-485 supplement J. hope this helps

@Jos S bizarre. I have just hunted my original I-140 approval out and I do see some wording on there that mentions the NVC but it says the following: “If the person petitioning decides to apply for a visa outside the US based upon this petition, the petitioner should file Form I-824, Application for Action on an Approved Application or Petition to request that we send the petition to the Department of state National Visa center (NVC)”. then it goes onto say the NVC processes all immigrant visa petitions that require consular action.
in first paragraph of approval document it actually states petition indicates the person is in the US and will apply for adjustment of status and then tells me to collect I-485 form from local field office effectively
how is yours worded?
Jos SApr 30, 2021
@Jos My I-140 petition says it has been sent to NVC. No text mentioning that I will be filing for AOS in the US (that I already did in parallel before the I140 was approved). But it says that I am supposed to receive a mail from NVC within 30 days. My layers said this is a standard language that is not relevant to me and I had already I-485 pending so I should just wait. So when I didn't receive any mail from nvc within 30 days I was OK. But now I see here people from Missouri posting that they had EAD/AP card in January and now green card with filing for AOS in Sep-Oct 2020 I am getting nervous. My lawyers were apparently mistaken when they told me to go rather with eb2 instead of eb1c because with their experience with the process under previous administration the eb1c is more insecure way and can take even faster.
Never mind, I will contact lawyers.
Congrats again and have a good family party to celebrate your green card 😊!!!

Just one more question if you will - Did they ask you to submit I-693 medical exams during the process?
Dave AMay 2, 2021
Jos S - hi our 693s were submitted together with the 485 applications 👍🏼
Jos SMay 2, 2021
@Dave - I see. Thank you!

is there a formal link some where that says they are bound to make a decision 60 days into receiving the rfie response?

congrats
