Filing Writ of Mandamus Pro Se After Long USCIS Delay — Need Guidanc
I’ve already completed the pre-mandamus process with my attorney. A demand letter was sent to USCIS giving them 60 days to respond, but unfortunately, I still haven’t received any meaningful decision. The only recent movement on my I-130 was a status update saying, “USCIS is currently processing your case.” On my I-485, I received a silent update related to the FBI/background check, but nothing further. I already completed my marriage-based green card interview on April 7, 2025, and I have been waiting ever since without a final decision. At this point, the continued delay has become extremely frustrating. Because I cannot afford to hire another attorney to file a federal lawsuit, I’ve decided to prepare and file a Writ of Mandamus on my own. I understand that filing pro se is a serious step, but I feel that I have exhausted the other options available to me. Unless I simply continue waiting indefinitely for USCIS, I don’t know what else I can reasonably do. This feels like my last option to hopefully get USCIS to take action and make a decision on my pending case. If anyone has successfully filed a Writ of Mandamus pro se for a delayed I-130/I-485 after completing their interview, I would greatly appreciate any suggestions, guidance, or personal experience you can share.

@Falove, well. Before writ of mandamus, my lawyer filed a case pre mandamus , and he charged me $800. He also gave the government a 60-day notice to respond.

@R T Hacking immigration law. he does free q&a sessions on youtube. he also does a lot of mandamus cases. I am considering him for my case in November.

@Za’s daughter S, I’ve heard about hacking immigration law as well, but I’m opting to file on my own instead of hiring an attorney and incurring additional costs. I’ve done this before and also paid for pre-manadmus, but now I’m only going to do it myself unless I continue paying the attorney, which is quite expensive.
