Filing taxes with a nonresident spouse
hi everyone, my husband never been to the US and lives overseas, he doesn’t have SSN or ITIN number! also no w2 or papers that proves his income where he lives now. So; can I file MFS without ITIN and not include his income? would that cause any issues with our I-130 visa or the sponsor application to the NVC? i know i can apply for ITIN and file mfj and probably get more money back but I don’t wanna go to that route and filing w7 form! i just wanna keep it as simple as i can and at the same time legal!

i wanna know too but being that your husband is out the country u don’t need proof of taxes tho because they know u do he is not there to do so! u don’t need to sweat it

well it’s complicated… if he’s not working in the US, is not a resident and doesn’t have an ITIN number I don’t see why he’ll have to file taxes in the US. personally you are complicating things unnecessarily. the I-130 which basically consist in proving that your relationship is real can be approved with other key evidence such as family pictures, joint bank accounts, text messages, bills, plane tickets that you have purchased to see him, bills, kids (if you have any) etc. my personal advice get an immigration attorney, he will guide you, and will make sure your application is filed properly.

Itin is for paying taxes in US without working .doesn't make sense apply when the other part is overseas.Contact a lawyer and ask a tax office about it

If you file as married filing separately then you don’t need to include your husband’s income

Use Tax Act to efile as married separately without your spouse’s SSN or ITIN. turbo tax and H&R Block won’t let you and tell you to file by paper. .
