filing mandamus
My interview was completed 224 days ago and still shows 'interview completed' and 'case must be reviewed.' I've worked for my sponsor for 3 years, but since last year, I've only worked 20 to 25 hours per week. I'm planning to file mandamus, but I'm unsure if I should wait for the decision or proceed with the filing, considering my part-time work schedule. Could working 20-25 hours per week impact my case?

technically you do not need to work till your Gc is approved, USCIS own policy states that so when you sue them they won’t arbitiraliy decide on your case outside of their policy. You are to work full time after approval of your GC.

i filed mandamus while working part time, they asked for paytubs after the mandamus, submitted and got approved. you are fine, go ahead and do mandamus

@Appa Appa how many paystubs they ask you . did they ask you the recent paystubs or the paystubs from your past year also?

@December 2020 if you want to go ahead but USCIS will look at your case with a magnifying glass but they can’t deny your case solely based on you not working right now. If all things are in order no need to be scared to file mandamus.

The delay is long enough that a mandamus consultation is reasonable. But if this is an employment-based case, your current hours matter because USCIS will care whether there is still a real qualifying job offer; before filing suit, I would make sure the employer can clearly document that the permanent position still exists in the required form.
