Filing I-485 and I-130 Together or Renewing Work Permit?
Hello, I am currently in the process of EB-3 Unskilled, and I already have a pending I-485. However, I am now marrying a U.S. citizen and want to adjust my status through marriage. My main question is: Should I file the I-485 and I-130 together (concurrent filing), or can I request to transfer my current I-485 to the new marriage-based process? I’ve heard that filing the I-130 separately may take longer, but I also don’t want to pay the I-485 fees again. Additionally, I need to renew my Work Permit (EAD). If I proceed with the renewal, should I send a letter to USCIS stating that my adjustment of status will now be based on marriage? Another concern: Can my current officer expedite my I-130 if I file it separately? I have already completed all steps of my EB-3 process, including the interview, and the only reason I didn’t receive my Green Card was the Visa Bulletin backlog. In this case, would I need to go through another interview for the marriage-based process? Has anyone been in a similar situation or has recommendations on the best strategy to speed up the process?

I would say submit your 130 and new 485 together. Transferring your 485 will just make it harder for USCIS to process and cause probable delay in your case. Marriage cases are processed faster nowaday so why don’t submit everything if you have the chance?

Better to keep your eb3 i485 and file new one. Did you ask to lawyer on this?

@V V I filed my I-485 and I-130 this month, and my biometrics were waived. Did you receive any RFE (because of your EB3) or biometrics appointment?
