filing date used by USCIS not priority date
i just received a response from USCIS saying we are not current because our filing date (04/05/2023) is not current for EB-3 category. All this time I thought its based on priority date (12/21/2021) that we have been current since Jan 2024 but apparently not. Did anyone get approved based on their priority date being current and not on filing date?

It should be based on priority date (LC file date). May be they thought you were talking about EB-3 unskilled? That one's not current for your PD.

The filing date cannot be priority date. I am sure you are current. We have the same priority date. I hope we hear the good news soon.

If your category is eb3 skilled then this is mistake on uscis side. Write a cover letter attaching the visa buletin and highlighting your priority date is current and refile again. If your category is eb3 unskilled then uscis is correct that you are not eligible to file AOS at the moment.

What I understand is that your PD is usually the day you filled PERM. I’d double check to make sure you didn’t apply as Unskilled instead of skilled. Hope everything goes well for you.
