Filing date error
Need inspiration please for my family and I . Our filing date 8/8/2022. PD 9/1/2021. Heard today that 10/24/2025 received the notice I received last year called “reject after ingest”, resets my filing date from 8/8/2022 to 12/8/2025. my Immigration attorney re-filed 12/8/2025 as a corrective measure I was told. Attorney says it was due to an administrative error by USCIS and we have to just re-file although it is not our (aka the attorney’s) mistake. I wanted them to do a follow up to see where our case currently is located. I noticed everyone speaks about “asking emma”. I was under the impression all along that this “administrative mistake” would not cause me any delays any longer. Was just informed that earliest I can do an inquiry is in 2029. Another 35+ months. How is this possible? 485J medicals every is up to date and filed. No interview. No RFE. Not one of 75 countries. Reject after ingest notice seems to have never been received by the attorney nor me. Attorney says they don’t even know if it really was rejected or not because nobody ever received the notice, just metely and update on the portal. And they renewed my EAD in November 2025 which I applied to be renewed before the “apparent reject after ingest” which I was told was an administrative error by uscis, that is why they had to re-submit everything. Does this mean I really have to wait another 35+ months or is there hope? Does it really mean I can’t even ask this Emma where my case currently is? National benefits center or a field office? Anyone ever had the same issue or experience?

USCIS lockbox office initially received your application package and entered it into their system, but later realized it shouldn't have been sent yet. They rejected it because your priority date wasn't actually active ("current") when you applied. it’s not an error but your lawyer mistake secondly for more information about your case if you have the receipt number try chatting with the live agent rather than Emma. it’s super easy just google it

@sam young I sort of figured that out after receiving the shock today… I still am in shock and very upset moreso to see everyone with the same PD as mine are being processed.

@AJ B if you have a current underlying active status then you can refill but if you have already used your EAD card i don’t think refilling is an option. which means you can’t do AOS. Your lawyer messed up.

@sam young it has already been refilled. Already completed new biometrics, resubmitted medicals, received new EAD’s everything. that’s what made me think that uscis made the mistake all along because they accepted everything again. our new filing date us 12/8/2025

@sam young I was steadily under the impression that USCIS really just made a mistake because they accepted everything again. we have not even received the first package with documentation back from them. the attorney said he think they have not really rejected it and I looked back at the date of filing and it was the correct date on the visa bulletin. that is the only thing that still gives me some hope because my date was current when they filed on the visa bulletin in 2022, and the fact that we never received the original document packages or any notice. they still have it on file at uscis.

@AJ B it’s good if USCIS accepted your application again. I would say consult with another immigration attorney just for a second opinion regarding your case. for case specific inquiries just chat with live agent. They will let you know all details about your case. best of luck

date of filling cant be correct date on the visa bullutin. Why, because USCIS were using final action date for filling. how I know that check on reddit "Help, reject after ingest" post. Like 10 people I know have the same issue. All of them refiled with NPT. USCIS accepted their cases. Lawyers made mistake and USCIS doubled down. Dont worry to talk with Emma agents. if you need more info, reach me out on reddit.
