fee I-140 NIW
My I-140 NIW application was rejected due to incorrect application fee. I wrote a check for $715, which is correct fee for I-140. However, the notice of rejection stated that amount was incorrect or not provided. Can you help me understand what this means?

It might be because of the, Asylum Program Fee that must be paid when filing Form I-140., otherwise it will be rejected. ps: This fee is on since April 1, 2024.

The Asylum Program Fee ($600) is a new fee paid by employers who file either Form I-129, Petition for a Nonimmigrant Worker; Form I-129CW, Petition for a CNMI-Only Nonimmigrant Transitional Worker; or Form I-140

To file correctly, you need to pay the reduced asylum fee ($300). To do that, you need to generate a separate money order or check or authorization for that amount separately from the $715. Now, when you fill your I140 form, you need to tick No for Question 5, Part 1; and Yes for Question 6, Part 1.

If you read Question 6, it might be confusing and you may question why “Yes.” But it asks if you employ “25 or less”. 0 is less than 25. So, Question 6 has to be Yes.

@Farhan Mirza follow the directions of @KY KY unless your application will be rejected again. if using credit card, you can pay $1015 with one G1450.

@F M NIW has nothing to do with your current employment. It is a self petition for future so you should still say YES for No. 6. You still pay $300

I also made the same mistake as @F M . I paid only $715 but USCIS sent me form I-797C and there's nothing written on the form except "APPLICANT COPY". my petition documents were also returned. I'm confused. can someone help me figure out what this means. plsssss. I posted the docs to USCIS from outside U.S and I'm really stressed

If you receive I-797 notice, it indicates that your case has been accepted and pending it should include a case number. You can use this case number to track your case online. Regarding fee , if you have submitted your application before April 2024 then $715 is the correct amount but if you submitted afterwards then I’m not sure about your situation.

@F M no, I submitted my application after April. the numbers on my form are 2 different numbers, one is a TRN# and the other a BIN#. I don't know their relevance though

@Kofi K, if your documents were returned, that means the petition wasn’t accepted. If that’s the case, I expect USCIS to return the check. What does the I-797C notice state? Receipt or Rejection notice?

@KY KY strangely enough the I-797C notice of action is blank. it just states "APPLICANT COPY".
