What was the reason it was denied? Do you have a lawyer? I think you can appeal the denial within 30 days of the decision date.

you can reapply as long as you are not divorced more than 2 years on the day of filing.

i290b takes 90 days or so, it will be approved once you have added evidence on the denial reasons

@victory 💃 Once a VAWA is denied, you have two options. As per the denial letter you should have 35 days to appeal or refile. I would recommend you to hire a new lawyer leaving the present lawyer and furnish him the denial letter and ask his opinion. I believe the new lawyer would review your denial letter and then he will be able to figure out if it could be appealed or refiled? Usually if the denial is for a specific area then he will ask you to furnish supporting evidence to appeal and usually appeal decision will be within 3-6 months but the risk of the appeal is there is a large chances of denial again. concerning refile, it will be considered more or less like a new application. Once you refile, your package will be reviewed by another officer in USCIS. Even my case was denied after 5 years and I had to refile because I received a 6 page denial letter as I didn’t have much joint documentation. I also happen to hire a new good lawyer and according to him I had to refile and once I refiled I received prima facie for the first time within 3 months followed my EAD and travel document called combo card. If you have a prima facie then it’s a positive sign. it’s been one year and waiting for the decision. Refiling sometimes gets decided within a year or may take 2-3 years. Therefore, you may follow whatever I advised you and you should be good. Also note that, if you have divorced from the abuser then you will w qualified to refile if you are within 2 years after the divorce date.

@victory 💃 If the denial is due to one reason due to not having attached that evidence, then you should be fine with 290 thing believing that your lawyer should have guided you in that way! I pray that you will be ok and hear the good news within 5 months hopefully. Best of luck.

@victory 💃 I was told by many that prima facie is a good sign for a case positive outcome and earlier I was too worried when I never received a prima facie in the first time of filing, but consoled myself that there are many who didn’t receive prima facie had got approved .But though prima facie doesn’t confirm the case is approved still on the surface of the case the uscis officer was impressed that he felt the minimum requirements are all met and this might not ask for any further RFE which might eventually go to the approval stage. We have nothing in our hands except to entrust into Gof and wait for the decision time. Amen

there is 2 kind prima facie determination letter and prima facie approval letter.

@Tom Hank’s Hans If the divorce happened more than 2 years ago and the VAWA petition is later denied, there is no option to refile the VAWA petition, except for filing an appeal or a motion to reopen/reconsider, correct?

@victory 💃 having a prima facie means, you documentarily qualified and case is in line waiting for adjudication. At the time of adjudication, you may receive RFE/Noid/approval/denial.

@K t When I refiled VAWA , my divorce period was about to complete 1 year and 11 months 🙂

@victory 💃 I also refiled after my VAWA denial in sep 2023 and waiting for approval. About the I-485 it takes anytime between 6 months and 2 years at the worst as per my heard news
