Does anyone have insights on above topic? There has been barely 3 months movement in last 2 calendar years. Historical average projects 10 months movement in a fiscal year. USCIS has approximately 60% staff working on cases compared with pre pandemic level as of 09/2022.

my understanding is that NVC made new greencards available until mid pandemic (June 2021), when the consulates were already closed, with the hope that they would reopen and catch up with the interviews. as we know this didn’t happen until recently so what is going on now is that the backlog is still being processed (also take in account that they are prioritizing F2A). That’s why the priority dates don’t move forward until they catch up. I agree that this is very frustrating (my f2b case is 3 weeks ahead of the current final action date). Whoever has more information please feel free to add or correct me.

Thanks for sharing @gus h and I agree with you but they should atleast give a monthly update on where we stand in line or which dates are they currently considering if not moving the bulletin dates cuz its been 2 years almost

also agree, the best we have is a general visa backlog report https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/visas-backlog.html . We do need more transparency from NVC

My PD is Dec 07 2015. Still waiting for progress to be made. Hang in there guys. Hopefully we see some moves this year.

Hello all, as per my communication with lawyer, people who applies for i485 (family based) inside the US does not need to follow visa bulletin action date. We have to follow timeline posted on USCIS website based on our respective field office. Upon interview, the visa officer will decide to issue GC right away or within a month timeframe.

@F2B AOS APPLICAT sorry but that’s wrong information you got because I had my 485 interview in May 2022 and the officer notified me that they can’t issue greencard until priority date is current on visa bulletin so whether you’re in US or outside u have to wait for PD to be current. My FO is Washington Dc and this is based on a true experience. Thanks

My interview was June 2021. Still waiting for GC to be issued. We have to wait for PD to be current no matter what.

Strange! Did you guys follow up with USCIS seeking clarity? There is no where it’s written that we have to wait for priority to become current on action date table. not doubting your experience, just curious to better understand the process. no there’s none information to be provided by our side the USCIS officer simply said that they issue visas based on visa bulletin which is for everyone so we have to wait for it to be current for our PD. Currently my 485 case status says the same that “we are temporarily pausing process of your case because a visa number wasn’t immediately available to you once a visa number is available for you we will resume activity on your case”

ohokay. so you filed the I-485 when your priority date became current being in the USA. However, at the time of interview, your priority date was not current in the Final Action Date chart due to which even though being qualified, you have to wait final action date chart for GC. Once your priority gets listed on final action chart, you’ll receive GC in mail. End!? You’ve not received any document/ stamp in your passport stating that you are a conditional/ unconditional permenant resident.

I agree with f2b waiting. Gov will only issue a visa when one becomes available, which is when the final action date becomes current, regardless if you are doing the process through consular with NVC or domestically through USCIS. What changed more or less recently is that you can request a change of status (i485) when your filling date is current. You may be interviewed shortly after but still the visa will only be issued after the final action date is current.

meaning that, during/ post interview, if the visa is unavailable then we have to rely on EAD and advance parole. Our status as a permenant resident won’t be effective unless our priority is on action date chart and have been confirmed to us through papers. The wait is for the rights and not just card.
