F2a, petitioning for my wife who is on J1 visa
Hey everyone,
I was wondering if anyone has been through a similar experience and can guide me. I am currently a permanent resident and my wife is in the USA on J1 visa. I am really confused about I-485 part, I have spoken to two layers and one said I can't file I485 till I-130 gets approved and another one said you can file it if your date of filling in the visa bulletin is current. I would really appreciate it if anyone can help me to clarify this process. Thank you so much.

As far as I know yes, you can file your I-485 if your PD is current in the chart b of the visa bulletin

@Khaled Mohamed , Due to the fact that you are a permanent resident and not a US citizen, you have to file the I30 and she will have to go back home to get the Visa interview. however, if you are a citizen, your pd is current and you can file concurrently I485 and I130. What you can do is file the I130 and also file for your citizenship. Then when you receive the citizenship you send the certificate to update the I130 which would make her pd current and then she can file the adjustment of status.

@Khaled Mohamed file I-130 ASAP. as soon as your PD moves before Filling date in Visa Bulletin your wife will be able to file I-485. in Aug they're going to accept AOS for those whose PD before Jun 15th 2024.
