F2A big concern
hello guys, can someone answer if i can still submit a form I-485. i already submitted my form I-130 last year and im confused if i can concurrent filing. does it affect my petition if they deny my application for I-485? thank you guys in advance.

Pleaee speak with an attorney before you file or just read what is being said on the USCIS website. F2A category has retrogressed meaning they are approving AOS cases filed up to Sept 2020. The visa category for F2A is not current.

Also, if you have accumulated unlawful presence, you definitely need to wait until the visa category is current before you file I-485, I-765 and I-131. Do not set up yourself for a denial. Speaking from experience. Hope it helps 🙏

If you are currently in status and married to a LPR you can file the AOS form, however, it cannot be approved until the visa bulletin is current. You need to check the FINAL ACTION DATE as well. Not just filing date.

@Shan Shan im actually petitioning for my wife. im currently here in USA and she is in our home country. im kinda confused if i can concurrent filing and file her the form I-485

@mark D okay, that sounds like consular processing if she is outside of the US.
