You mentioned that your spouse live in the US. Have you submit I-485 ? you do not have to wait until it is approved to submit I-485. For people who is filing concurrently, your I-130 will be approved when your I-485 approved.

Both me and my spouse live in the US. She is a LPR, are you sure I can submit the 485 and 765 before 130 approval?

Are you completely certain about that? coz I’m told I cannot do that now. And yes I’m under lawful status right now.

Yes, they say if you are still under lawful status and a visa is currently available you can file i485. I’ll say call them and talk about it. because I’ve seen LPR on this app applied for both for their spouse.

I am in same situation as you. My spouse is on F1 and I am LPR. we submitted all applications together I-130, I-131, I-485, I-765. F2A is current and can do that as long as your in status. Spouse already did the finger printing

@Ann D - calling them and talking first makes sense to me. @Adam T - It makes sense because you filed all 4 of the forms together. But I have filed only I-130 so far and still waiting on decision. Is it definitely okay to file I-485 and I-765 right now? before I get an approval for my I-130. I just do not want them to deny my case. That will not be good.

I submitted I-130 online and 10 days later mailed in the rest of the application with I-130 receipt. I do not see any reason that will make them deny it. What kind of visa do you currently have ?

I’m on a student visa right now. Mostly my company will apply for my H1 next year as well but I do not want to wait on it.

did you get the reciept for I-485 and I-765?

Student F1 visa, you should be fine. yes, we did receive the receipts and already did biometric for I-485 and I-765

Also, you mentioned that ” I am told that cannot do that”. mind me asking who told you that? Were you ever on J-1 visa?

I was never on J1. I’m only F1 and nothing else. I’m on CPT right now. One of the lawyers I met before filing told me that

F2A is current for all nationalities. I do not see a single reason stopping you from submitting I-485, I-751, I-131. I have the exact situation as you, spouse is on F1 visa married to LPR, both live in US. The priority dates for F2A been current since more than two years ago. Good luck!

@P P: I have seen so many cases submit I-130 first then wait for it get approved then did the I-485 next. However, there are some cases they did submit all forms. I dont know why?

@Thi Nguyen: My priority date is on August, 25, 2021. The I-130 processed is in Calf. Service Center and the the rest of them are in the National Benfit Center. The local filed office is Cleveland, OH. How about yours?

@Adam: I only submitted I-130 online, cuz the immigration service told me I have to wait until I-130 approved, then I can do I-485 (if my memory is right, USCIS also states the same thing). But anyway, I am going to submit all papers as you did for your spouse.

@Adam @Thi - I’m planning to submit the rest of the documents as well. Bevause the processing right now is making no sense. I’ve seen people on this app who are F2A with PD in July 2021 with approved I-130 and some from Jan 2020 still waiting.

The only thing I’m worried about is am I definitely allowed to submit before i-130 approval? coz even my lawyer says we have to wait for the approval.

yeah! That is the problem! Most of them are in F2A Category sumitted all forms together. They get approved faster than those who only did I-130. However, it depends on how fast your field works on.

Yeah that’s true. But I don’t understand how F2A’s apply concurrently. coz they cannot actually do that according to uscis.

Yes that’s what Adam suggested. and it’s been current for a long while now. that is why I’m planning to send 485, 765 and 131 now.

yes! lets do the 485, 131 and 765 then submit it. Also, you dont have to wait for 130 approved. We are eligible to do it cuz we are already in US and we are stay here legally with F1 visa!

@ Thi Nguyen. Thank you! I had a REF ( co-sponsor needed) on April 27 and I responded on April 30. Then on May 11 interview scheduled for end of June. Yes, I am still on F2A. I believe once you are in the US it does not so much matter if you are on F2A or IR since it maybe depend on the field office and the officer. Hope that you will hear good news soon.

@ T Nguyen. We had the interview and we believe it went well. The officer was super nice and ask a few basic questions and the yes/no questions and how we meet and etc. The officer did not mention when we would hear back but mentioned that everything looks good and to wait for mail from us. Then, I-130 was approved the next day and waiting on I-485. All the best!

@T no I have not yet submitted all the forms. my lawyer was against submitting anything until we get i130 approval. but my patience is wearing thin now and I’m try to either expedite the case or submit the rest of the forms. I’m just worried about submitting all forms together since I’m on F1 day 1 CPT. I don’t know if it’ll affect my case in anyway.

i am F1 and Adam’s spouse is F1 as well. we DID submit all forms withtout any problem! please try to do it ASAP!

@P P You are doing nothing wrong by having CPT; you are eligible for it and still holding F-1 status. So, submitting I-485, I-765, and I-131 should not hurt your situation at all. I am very much curious to know what is the lawyer's rationale behind not submitting them. Have you tried to consult with a different lawyer? Good luck!

@Adam the lawyers rationale is that because my spouse is an LPR we’re not eligible for concurrent filing. had my spouse been a US citizen we would be eligible to file concurrently.

another question. did you send the rest of the form with i130 or sent it later on? if you sent it later on where did you send it exactly? to your service Center?

@ PP got it. I did file I-130 online and uploaded all documents needed. Then 10 days later I filed I-485, I-765, I-131 to Chicago lockbox and I included I-130 receipt on the top. Also, where you send your forms depends on which state you live in. @Adam: you are so kind! thank you for your time! I have seen many cases approved without interviews. but most of them get 2 year GC instead. I think USCIS will break the backlog soon but probably they will need to come for the 10 year GC interview. just my guess.

@Adam T @T Nguyen any updates on your case? My 130 is still actively reviewing as of 8/11/22. 485 and 765 actively reviewing as well as of 12/28/22. And no updates on 131.

hi PP: I got my EAD 2 weeks ago. PD May 4/21.

@T Nguyen @P P PP I hope you get your I-765 and I-131 approved soon. I-130 usually donot have any movement when it is accompanied by I-485, it usually get approved along with I-485. For my wife case, we never received approval for I-765 or I-131. submited everything I-130, I-485, I-765 and I-131 on August 2021. Interview June 2022 and I-485 approval on August 2022. I-130 was approved next day after the interview and I-485 was approved 33 days later. Nguyen : Glad you were able to get your I-765, so you can renew your DL. All the best and keep us posted! 😊

@Adam: thank you for your kind words! I was able to renew my DL before i765 approved by using i485 receipt number and my husband green card. DMV gave me 1 year driving permit.

@Adam T I’m hoping things move a little quickly now. it’s been way too long.

@T Nguyen She is on the 5 years rules, so that will be like May 2027. For me is also 5 years, that will be like April 2026. Even if I become a citizen, that does not automatically allows her to use the three years rule since I should have had my citizenship for at least 3 years before she become eligible for the three years rules. Around May 2024 we should apply for removing the condition since she recived 2 years green card. @P P I hope so, I see a lot of interview being waived, so I hope you and @T Nguyen got that and Green card straight.

my interview is next week but yesterday I received an online notice of request of initial evidence asking for medical exam and vaccine record which I was asked to bring to the interview date. i dont know what to do. should I go to the interview with the medical result or mail it as requested?

@T Nguyen If I were you, since you just recived the REF and you would have at least a month to respond to it, I would take it with me to the interview along with REF letter and show them to the offficer. Good luck and you wish you all the best in the interview!!
