F1 student -principal applicant- my spouse asylum pending after expired visa less 180 day looking AOS.
Hello, I want to tell you about my situation to see if you know of a similar case. I am the main applicant and I am an F1 international student and I have maintained my status. in march my I-140 was approved for EB3- other workers. before this I married my husband who is an asylum seeker. he applied for asylum after his tourist stay expired but obviously before the year. i.e. he has less than 180 days out of status. he is applying for advance parole. if he leaves and comes back and enters with advance parole does it help him to adjust status? is he evaluated the same as me? or is he analyzed as if he were for example F2a?
