F1- OPT—> EAD/AP card (AOS- marriage)
I was under the F1 OPT and STEM work permit but recently got my EAD combo card under my i485 application. I would like to change employers since I could get a manager position with another company. however, I don’t want to risk my application due to the change of field offices. I’m live in GA and the new job may be in Florida or Virginia. has anyone changed jobs while waiting for AOS under marriage based application? #atlanta #florida #VA

@Kk k lawyer told me the moment I filed back in March, 2022 I was not longer under the f1 opt status… I will let my previous school know about the change just in case.

@kkk when I applied I was under the STEM OPT and that EAD expires next year. I just got my combo EAD card under my greencard application.

so that your intial opt right for 1 year. You are good bro. If you want to switch to the greenc card ead inform you dso about it and they will terminate the F1 as complete.

I'm in the same situation. i filed for opt extension 2 years before AOS. I have my opt stem extension now waiting for my ead for GC.

@Kennedy. Not to terminate your F1 status means, you’ll still be paying tuition till you get GC. I think the moment you file for AOS your status change. Any reason why you said one should maintain the status?

@Fe waiting.To me it’s more safer not to, not saying that they will deny the application but the school alway advises not to terminate your status before. That’s why they always ask for a copy of the GC when terminating.I’m speaking from my own experience

they’re the option of not doing anything. ISSS and or USCIS will terminate it with time, not sure who does it. or do it yourself when you get the GC

I think they moment you failed to enroll for a semester for no documented reason. The status got terminated automatically.

Denis - If you have GC already, then your F1 no longer applies. one cannot have more than 1 status at a time, and GC and F1 are two different statuses. USCIS has your files and they're the ones in charge of granting or denying statuses. so, if you already have GC then they've canceled the F1 status already and the school will be notified. you can notify the school as well, but USCIS and schools in general work together to ensure that the schools are not breaking any immigration laws. now, about changing employers, I don't see why you couldn't under GC or AOS. if you have an EAD with no restrictions on the employers or fields of studies, then you can do that. it all comes down to the most recent documents that you have. if your EAD is under the F1 stem, and the new field is not stem then you can't change employers unless the new one is in stem. if your EAD is under GC or AOS, then you should be able to change employers regardless of the field. but it is your responsibility to read what your documents say and whether they have any restrictions or not. either way, your latest and most current EAD is the one that counts. it is my understanding that you have an EAD under AOS. am I understanding correctly? if so, then you shouldn't have issues changing employers.

i was under f1 visa before getting my green card as well. the advisor from my school suggested me keeping my f1 status until the green card is on hand. I applied for work permit along with i485, and they told me to use the ead of opt just in case something unexpected happened, you’re not out of status. I never heard that your f1 status is terminated once you apply for adjusting status.

@Lilo and @Mia T : thank you for your responses. I’m working under my new EAD -AOS and now waiting for my interview. I filed back in March, 2021 so hoping this app is accurate because the app is in close for an interview.

I have an opt EAD for the first time , I couldn’t get a job in the first 90days , and I’ve submitted my new UCIS receipt to my school , my school international student office contact said I am good !!

@Mia T… the app was right for me for my AED combo card but for the other forms are reviewed at the field office so that may affect the timeline.

Denis - you're welcome. 🙂 Mia - you're correct, schools don't terminate your F1 status if you apply for another status/change of status. your previous status is only terminated if you acquire another one, as one cannot have more than 1 status at any given time. AOS is not a status. what you're adjusting your status to is the status. so under AOS, the status that you had before applying for a different status is still current as long as it is not expired. 🙂 but if you receive an EAD while on AOS, then that EAD takes precedence over the previous EAD. in Denis' case, his AOS EAD takes precedence over the F1 EAD. 🙂
