Expedite requests don't slow down your case.
Expedite requests are a way to tell USCIS that your case should be treated before anyone else's, basically. That's why the approval rate of those requests is very low, as you need to give USCIS compelling reasons as to why you should jump the line. Here's how expedite requests work: you submit one, and it gets assigned to an officer. If this officer deems your request worthy of processing, they will request more documents to support your claims. If the expedite request was submitted by a congress representative, then they already sent all supporting documents (they require you send them those before they plead your case with USCIS). When the USCIS officer has all that they need to process your expedite request, this is where they decide whether your case is strong enough to be taken from the queue and approved right away or not. If your request is very strong, they approve your petition. If not, they deny your expedite request and your petition stays in line in the queue, where it was before you or the congress representative submitted the expedite request. So, you see, expedite requests don't slow down your case. They can speed it up, hence the name, but they don't slow it down. Also, expedite requests are reviewed on a case-by-case basis, and the USCIS officer who reviews each request makes decisions at their own discretion. That means that an expedite request can be very compelling and still be denied. It's not personal. I hope this helps. 🙂 #expediterequest #expedite #ead #expediteead #eadexpedite

how about service requests?
m
mel mNov 18, 2021
so what if they don’t respond after 30 days and you have to resubmit a new one again?
Lilo PelekaiNov 18, 2021
Eric - unfortunately, most service requests don't go anywhere most of the time. they were designed to get assistance from USCIS about cases outside processing times, but unfortunately, the backlog at USCIS rendered that service almost useless. 😕 Mel - you only get a response about your expedite request when it is assigned to a USCIS officer. no response means it's still pending, unassigned (you cases remains in the queue untouched). normally, when you submit the request, the agent tells you that you should hear from them by email within 7 business days, and to call back if you haven't heard anything within that time. now, I've seen cases where people got the bad luck to speak with not so nice USCIS agents who were very unhelpful. but if 30 days have passed, I would resubmit one. in dire situations, one might not have 30 days to resubmit a request. that's the idea behind the original "7 business days for a USCIS response", because expedite request are intended for urgent situations.

okok, but SR don't delay processing , correct?
Lilo PelekaiNov 18, 2021
H K - you're very welcome. 🙂 Eric - correct. the only delays in your case may happen if more documents need to be submitted, your case is relocated to a different center, you change lawyers during the process, ... other than these, your case should remain in its spot within the queue until it's its turn to be adjudicated. 🙂

due to the pandemic they said to wait 30 days and that 7 days wouldn’t apply
Lilo PelekaiNov 18, 2021
Mel - ooh, I see. when I contacted them last month they always said 7 days, and were very nice and respectful over the phone. yes, whatever timing they give you, go by it and contact them again if you haven't heard/received anything from them past the timing they gave you. 🙂

G R - it all depends on the officer and how long they spend on your case. this looks like an ER and they're letting you know they assigned it to an officer for review. "Acceptance" is what tells me that, and there are 3 scenarios that can happen from there: 1. the officer reviews the request and needs more documentations. they will send you another email with instructions on how to send those documents (proof of your claims in you ER). that's within 2 days in theory; 2. your ER is strong enough in its own merits based on your claims, and therefore the officer decides to approve your EAD on the spot. 3. your ER is rejected. if the request goes with scenario 2, then you should receive an approved decision of your EAD within hours to a day, depending on when the system updates. and from there you should have your card in hands within 10 days.

Hi, Lilo. I was wondering if I could submit another expedite after three weeks, or I have to wait 30-day sharp to submit another expedite request? Thank you!!~~
Lilo PelekaiDec 11, 2021
hello Giselle. it really depends on the timing that they gave you. if they said 30 days, wait for those 30 days. and that's usually business days, weekend and holidays excluded. on the 31st day, give them a call to inquire about the expedite request before you submit another one. if yours hasn't gone anywhere, then try and turn to your Congress representative for them to send one on your behalf. expedite requests are very competitive and the approval rate is very low. so, knowing that, make sure that your case is strong enough to sway the officer who reviews your request in your your favor. 🙂

Thank you, Lilo. I will wait and then keep trying!

@Lilo need some advice. My wife is a LPR she’s expected with due date 20 January 2022. she applied for the case in June 2021. She’s currently living with her mom but has mortgage on her and her sisters name. can we expedite on humanitarian basis as she will be a mother living without husband? something like can work?
Lilo PelekaiDec 28, 2021
Munawar - congratulations on your new bundle of joy! 🤩 what case did your wife apply for, if I may ask? if I presume we are talking about the EAD, as a LPR, she has the right to work in the US legally and does not need an EAD card. her green card is sufficient proof for her legality and authorization to work. 🙂
M
Munawar SaeedDec 28, 2021
@Lilo I am talking about I-130 that she had applied for me. not EAD. I am currently outside of USA.
Lilo PelekaiDec 28, 2021
Munawar - Oh, I see. I am not sure if that's going to do anything since it is not for her but you. even though she's the petitioner, you're the beneficiary and not the one in a situation that would qualify for humanitarian emergency. I may be wrong, and would advise you to check with an immigration attorney. but USCIS won't see you as in any emergency situation and would not grant the expedite if it is requested. you have nothing to lose for trying, though. you may be lucky and get a very sympathetic officer. 🙂

What does it mean to Follow Up request?

What happens if they ask you to send proofs and you dont send them anything? Does this means the case file will be kept aside until proofs are received by them?
