eoir i-485 to uscis
So, I was in removal proceedings, and when my I-130 got approved, an immigration judge terminated my removal proceedings with prejudice, and I had 485 initially filled with cord, and was sent to Texas Service Center. Since my removal proceedings got terminated, instead of filing a new one, my lawyer suggested me to transfer jurisdiction from cord to USCIS on existing I-485, and my lawyer sent all the supporting documents with immigration judge's termination letter to local field office, and it's been three months since the package was delivered, and I didn't hear anything from USCIS. I've been calling them, making inquiries, and no response at all. All generic response. And I got a call back from the fire department. And they're telling me that we have sent a request for your inquiry to the local field office. I got call back from tier 2 And they said your case was transferred to the local field office from National Records center
So I spoke to my attorney and he suggested me wait another a month or two and then you can file mandamus in order to make USCIS act and acknowledge the jurisdiction on your I-485. That's how we do it. So I'm here for second opinion. If I file mandamus, would this help with case like this? Please advise me. Thank you.

I would say this. my attorney was amazing and she helped me get approved. However, I also did my own research and made some moves that at the end even my lawyer was impressed and USCIS agreed with my argument allowing me to take my win even further. so to answer your question. Yes, go for it. it is your life we are talking about and no one cares about it more than God and yourself. Go do it you’ve got nothing to lose and more to gain.

@huss_00 k not the same, but required some major investigation from their part. but definitely doing your research and understanding how the process works allows you to have the right tools to fight

3 years pretty long. If you think about mandamus, do youtube search "writ of mandamus pro se" many people got help from there.

@huss_00 k Our case seem the same situation since 2021 .i130 was approved in 2022 and removal terminated in August 2024 since then no update til now 8 months .

where did u send all docs to uscis notify them your removal termianted ?
did you ever do congressional inquiry?
did you ever got notice in mail or reponse to inquiry in email by uscis saying that
a review indicates your removal terminated and uscis has jurisdiction on your case now we requested and received your file and given to supervisor to review and complete processing?

@huss_00 k yes. did a lot of info pass yes I spoke to Tier 2 many times yes I sent my termination letter to uscis field office , yes they confirmed they received it but no I didn’t do congressional enquiry. uscis just told me they working on my case as usual lol but I don’t trust them . Uscis don’t like us and don’t care maybe writ of mandamus would be the next thing I would do .

@freeman 1 i sent new medical , new i-864 i-130 approval and judges order to local field cuz my i-130 and termination happened in december 2024 , after sending too many inquiries uscis sent me email
“A review indicates that your removal proceedings have been terminated or dismissed by an Immigration Judge. As you are no longer in removal proceedings, USCIS now has jurisdiction to adjudicate your adjustment of status application. We requested and received your file for further processing of your application.Your application has been given to a supervisor for review. You do not need to do anything at this time. If we need any additional information from you, we will mail you a request for evidence at your current address on file with USCIS. When we make a decision on your case, we will mail a notice to you or your representative at the address you gave us.”
i did congressional inquiry yesterday .
just so u know i had to do write of mandamus for my i-130 then got approved .
