@survivor p :are you sure ? my 485 has been pending long time , Rfe medical notice was lost , online account didn’t showed anything about rfe , I just found out by calling last day of rfe , tima was out , congressman helped me to contact uscis , then uscis asked me to send them my refe even time was out , i did it two time one without copy of rfe , couple days later I sent them second copy with rfe copy , 67 days passed no any update on their system, no this issue happened. I definitely will call uscis tomorrow, and inform them about the issue but I didn’t have agent name and Id . do you know how I can talk with their supervisor?

@hope hope you have to ask for supervisor. they will ask you why, you can say because of issues caused by previous agent

@survivor p ; tonight is my hardest night. survivor, are you sure this issue isn’t effecting my 485 , I googled about it , google said I need to apply for i-290 form . Oh Lord help me

@hope hope it shouldn’t. I didn’t know you did file I-485 before. that’s why your VAWA based takes longer. usually it is like that. definitely call them today and talk to supervisor

@survivor p i had 130 , 485 , when my EX withdrew his 130 , my 485 got denied. couple week later I applied 360 and new 485 .

@hope hope Just ask to speak to a Tier 2 officer those have much and broader explanations and clearance to in-depth of a case.

@hope hope Out of normal processing time placed on your denied i485 won’t have no effect on your new i485 because that’s i130 based denial and the new one is i360 based so it’s two different cases you should just let them do it on the right one. Call and Speak to a Tier 2 officer

@hope hope your denied I-485 would not affect your I-360 and your new I-485. I had almost the same case as yours but mine was that my significant other refused to come to the interview, so I went and told them I had filed for Vawa and would appreciate it if they would hold the adjudication of my I-485 in abeyance pending the approval of my Vawa. About a year later I was scheduled for another interview based on my I-130 and only found out when I got there. The immigration officer adviced me to refile another I-485 stating that based on the fact that my I-130 filing precedes my I-360 they can’t hold it. So I was adviced to refile another I-485 and send in the receipt with a withdrawal letter for the previous I -485 so it won’t be denied and then affect my work authorization. I did just that which they acknowledge online and wrote a letter stating that I am legal for the period of my work authorization which is 5 years and pending the adjudication of my Vawa. So I will say you are good. Your old I-485 won’t affect your current case even though it is as denied however it provides you the grounds to file for Vawa since as someone married to a US citizen or LPR.
