End of EB3 Unskilled
I made this comment in an EB3 Unskilled group, where I present some data.
Hello, I'd like to establish some statistics. Let's go through the numbers of Green Card EB3 Unskilled issued per fiscal year:
- 4,310 - 2019
- 5,549 - 2020
- 4,885 - 2021
- 8,894 - 2022 (in this year, we were already in retrogression, and there were 1,106 visas wasted. But it's okay; immigration needs to be cautious not to hit the visa cap, so it's possibly safer not to reach the limit of 9,999).
In the fiscal year 2023, the visa bulletin started the PD in June 2020 and began the next fiscal year with the priority date for August 2020. So, during this short period, did immigration not have visas available? It seems unlikely, considering that the numbers of approved LCs during this time were the same as in other years. There was only a significant increase in LCs in 2022. Assuming that immigration advances one month every three months, and there was an increase in LCs in 2022, this will become a snowball effect, with the EB3 process taking about 7 years.
The annual quota for EB3 Unskilled is 10,000 visas per year because America bases this number on the need for this amount of workers annually. As we have a crisis at the border, we know that about 2.5 million people came through the border last fiscal year. Assuming only 0.5% received a work permit for the asylum process, we would have 12,500 people annually working in unskilled jobs. Yes, unskilled jobs because most do not have proficiency in English or any qualifications.
So, I presume this might be the end of EB3. I filed my process at 20 years old, hoping to do something legal, as I had no qualifications and didn't want to pay international student tuition for college, which are much more expensive. Now, I'm 23 years old and feeling hopeless. Anyway, I really hope to be wrong.

Please, everyone, comment anything on this post to give more visibility here in the app and show people that it's not a lack of available VISAs, as lawyers and immigration agencies lie to keep selling their products in false hope that this retrogressive will end soon.

I think this whole category is a joke and USCIS doesn’t take it seriously because just look at other employment based categories except unskilled how fast they are progressing like they are always current. I’m pretty sure boader crossing & asylum has some connection with eb3 unskilled category and that’s the reason it’s not progressing it almost looks like they don’t want to make it move forward or progress. DOL need to put stop on people filing LCs or I-140 if they have limited number of visas until the retrogression is over or the category is current otherwise there is no solution. i think situation is even worse now because for AOS you can’t even file EAD or I-485 so this means this category is almost blocked. we are in 2024 and they are still stuck in 2020

worst part is people without any idea about the process and how long it actually takes applying now and making the backlog even worse. Not to mention that asylum applicants probably got the new EAD of five years and some of us are still having to attend school and can’t work or travel outside the U.S. The truth is that sponsors and applicants should sue USCIS for unreasonable delay in the process, if we knew a few years ago that this could happen, most people wouldn’t apply for it

@lucas s I agree with you, if I know I won’t apply, My life is stuck with unskilled work, can’t move on
eb3 unskilledJan 21, 2024
@lucas s That’s true.
However, I think applicants have high expectations. Some guys need GC for many reasons like travelling back home for a break, sponsoring their spouse/kids, getting high paid jobs and so on. Me, I can work this unskilled job forever because it fulfills my current needs. Perhaps, I may ask for OT or promotions after I get GC. This keeps me far away from desperate. Enough is enough.
Just sharing my thoughts, every cases are different.
