Employment Layoff After Receiving Greencard
What happens if the employer releases one month after getting green card. Usually it was suggested to stay with employer around 6-12 months. I need to file i824 for my spouse to follow to join. But the release case is scaring me.
Thanks in advance. #fiance #greencard #approved #layoff

I would wait to file for spouse, but you already have greencard you should be fine. it’s not your fault.

Friend had similar situation in 2019. Make sure you document the layoff and evidence of the reasoning behind it. It will absolutely come up in the future when you get called for an interview at USCIS. As long as you have evidence you were employed with good intent and it was unforeseen/unavoidable you would have no problems. Documenting as much of the reasoning and story behind why you got laid off is very important.

If you get another job in a similar field, that should suffice. Ask for documentation of the layoff and keep it for the future.

The 6 months courtesy only applies if you leave the job. But if you are released then you have nothing to worry about.
